USR asks the Senate to adopt the reduction of per diems for magistrates: “The “carrot” used by the oligarchy at the head of the judiciary”

USR sent a statement on Sunday calling on the parliamentary parties to approve the draft law that reduces the per diems of magistrates “to the level of the fixed amount provided for civil servants”.

According to the USR, at the present time, magistrates benefit from a per diem for delegation or secondment of 2% per day of the gross employment allowance.

The project initiated by several deputies of the party, which is on the agenda of Monday's meeting of the Senate plenary, received a rejection report from the legal committee.

USR claims that the current per diems are the “carrot” and the “stick” in the judiciary

The bill “by which the per diems of magistrates are aligned with those of civil servants” was submitted by several USR deputies in December and is on the agenda of Monday's meeting in the Senate, with a rejection report, the party stated.

“Let's put it in context. 2% per day of the monthly salary actually means 40% per month. This substantial increase is the “carrot”, the positive motivation used by the oligarchy at the head of the judiciary today, to convince the magistrates to accept the delegations and secondments”, said USR deputy Alin Stoica, one of the initiators of the project.

The parliamentarian claims that the current level of per diems “also constitutes the “stick”, because the termination of the delegation or secondment also comes with the loss of this financial incentive”.

USR said that the president of the High Court, Lia Savonea, gave the other day that “an order sheltering this “friendship allowance” from possible modification, including it in the salary, in the case of magistrates seconded to the SIIJ”.

What does the draft on the agenda of the Senate provide

The draft law provides for the amendment of art. 13 para. (1), in the sense of establishing the per diem and the delegation or secondment allowance at the level applicable to the staff of public authorities and institutions, eliminating the percentage reporting to the allowance, according to Agerpres.

At the same time, the initiative aims to introduce a new paragraph, which establishes the situations in which magistrates do not benefit from per diem, transport or accommodation, these being if they are delegated or seconded to their home town, in a town where they or their spouse or dependent children own a home, as well as in a town located at a distance of less than 20 km from home, regardless of whether they own or not living in that locality.

The project received a rejection report from the Legal Committee of the Senate.
