The Constitutional Court of Romania (CCR) is discussing on Wednesday the referral of President Nicusor Dan regarding the law that allows local authorities to receive up to 20% of tourist beaches on the Black Sea for free.

In November 2025, the head of state sent the Constitutional Court a notice of unconstitutionality on the Law for the amendment and completion of the Emergency Government Ordinance 19/2006 regarding the use of the Black Sea beach and the control of the activities carried out on the beach.

The CCR was originally supposed to rule on January 21, but postponed a decision until today, March 4.

The disputed law establishes that the owner of the property right of the beaches can assign for free use to the local authorities from the Black Sea coastal towns, at their request, a share of up to 20% of the surface of the beaches used for tourist purposes that are located within their administrative-territorial radius, to be developed as public beaches.

The owner of the property right is the state, since the seafront and beach are included in the list of assets that belong to the public domain of the state, it is mentioned in the notification.

President Nicușor Dan claims that the local authorities do not have the capacity to receive free use of up to 20% of the tourist beaches, because they do not represent institutions of public utility.

Thus, the president says that the law contravenes the provisions of article 136, paragraph 4, the final sentence of the Constitution, as these entities do not represent institutions of public utility.
