In the Yemelyanovsky district, an official illegally transferred a forest plot to private ownership (video)

The Investigative Committee opened a criminal case for abuse of power causing grave consequences in relation to Head of the municipal government institution “Center for Supporting the Activities of Local Government Bodies of the Solontsovsky Village Council of the Emelyanovsky District of the Krasnoyarsk Territory.”

According to the investigation, in May 2021, the accused, holding the position of head of the MKU “Department of Land and Property Relations and Architecture of the Yemelyanovsky District Administration,” illegally provided ownership of a plot of land located within the boundaries of the state forest fund to a local resident for personal farming, which he was reliably aware of. The defendant transferred the plot without bidding at a price of 111 thousand rubles, while its cadastral value was 4.5 million rubles.

“The institution agreed to lease the site for 5 years by concluding an agreement. However, information was subsequently received from the Ministry of Forestry that the borders intersect with forest fund lands and a specially protected natural area of ​​regional significance. It was proposed to remove the site from the cadastral register. Despite this, after the appearance of a residential building on the site, the MKU prepared the transfer of land ownership for a very modest 2.5% of the cadastral value. The local TSN “Otdykh” went to court, demanding that the decisions on rent and property be declared invalid. The first instance agreed partially, but the appeal and cassation overturned the decisions due to the applicant’s lack of real rights and the presence of approval from the ministries at the initial stage. During the decriminalization of the Emelyanovsky district, the prosecutor’s office checked and was convinced: the site crosses the boundaries of the forest fund, which are limited in circulation, thereby its transfer to a private sector resulted in damage to the municipality and the environment,” said the supervisory department.

The day before, the official was detained and a measure was elected suppression in the form of house arrest.

Currently, in a criminal case (clause “c”, part 3 of article 286 of the Criminal Code of the Russian Federation) inthe necessary investigative actions are carried out aimed at establishing all the circumstances of the crime committed.
