The government is introducing 126 deregulatory changes. “This is just the beginning”


During Friday's press conference, the Minister for Supervision over the Implementation of Government Policy and the Chairman of the Government Deregulation Team, Maciej Berek, said that the government had received 522 deregulation demands from the public, and had accepted 354 for implementation. He added that 193 changes had been adopted by the government, of which 126 had already entered into force at the level of laws and regulations or “through other actions”. He indicated that work is still ongoing in the case of 161 draft changes.

The most important changes in regulations
Among the demands implemented, Berek mentioned, among others: extension of the so-called the principle of tacit consent. It means that in selected cases, the lack of response by the authority within a specified period means that the matter will be automatically settled in favor of the citizen.
The minister also pointed to the digitization of court proceedings as an important change. The possibility of submitting procedural documents in civil and criminal cases in electronic form has been extended. An important change from the perspective of entrepreneurs was also – in his opinion – the explanation issued by the Ministry of Finance that the payer can choose the form of submitting PIT-11 information. This can be done electronically, by mail or in person.
The obligation to store paper copies of reports submitted electronically to ZUS has also been abolished. Currently, documents sent online are enough, without the need to print and archive for 5 years.

As noted by the head of the deregulation team, the principle of the taxpayer's presumption of innocence has also been introduced. This means that in proceedings initiated ex officio, if after conducting the entire evidentiary proceedings there remain “irremoveable” doubts as to the facts, the authority must resolve them in favor of the taxpayer.
Smaller enterprises will benefit – as Berek noted – from the increase from PLN 130,000 to PLN 170,000. PLN threshold of the contract value from which the Public Procurement Law must be applied. This is intended to simplify the application procedure, which will make it easier for smaller and small companies to participate in tenders.
After 20 years, it was also increased – from PLN 200,000 to PLN 240,000. PLN – limit of annual revenues above which entrepreneurs are obliged to pay VAT.

What's next?
The minister also pointed out that one database has been introduced in which entrepreneurs can find data previously scattered in several registers. There is no longer any need to check contractors separately in the National Court Register, the Central Registration and Information on Business and the VAT list.
The Chairman of the Government Deregulation Team also informed that the government is thinking about deregulatory changes in the areas of tax law, court proceedings and local content. He noted that these would be “larger projects rather than small ones.”

When asked by journalists what form the changes in these areas would take, he announced that the government wanted to prepare a systemic project. — We will now look for a solution that will allow us to rationalize the process management expenses a bit [legislacyjnego]so these will be larger projects rather than small ones, Berek noted.
On February 10, 2025, at the Warsaw Stock Exchange, Prime Minister Donald Tusk announced the commencement of work on deregulation, and invited the founder and president of InPost, Rafał Brzoska, to cooperate. The initiative he established, Checked My, started preparing deregulation demands. March 4 last year the government established a deregulation team led by Maciej Berek. The team included: the Minister of Finance, the Minister of Development and Technology and the President of the Government Legislation Center.
