The Council of Ministers adopted the draft reform of the National Labor Inspectorate, said government spokesman Adam Szłapka on Tuesday. The regulation prepared by the Ministry of Labor assumes that PIP will be granted the right to convert sham civil law and B2B contracts into employment contracts.


Giving PIP the power to transform contracts is one of the so-called milestones, the implementation of which determines the payment of funds from the National Reconstruction Plan. Poland has time to implement the EU directive until June 30 this year.
The first version of the PIP reform project prepared by the Ministry of Labor and Social Policy was not accepted by Prime Minister Donald Tusk. As the head of government explained in mid-January, excessive power for officials introduced by the reform would be destructive for companies and would mean many people losing their jobs.
The new version of the project was published at the end of January on the website of the Government Legislation Center. It upheld the competence to transform civil law contracts into employment contracts to the National Labor Inspectorate, but clarified the appeal process against the inspector's decision.. This appeal may be directed to the district labor inspector and then to the general labor court. Until the final decision is made, the inspector's decision will be suspended. Therefore, the project does not introduce the rigor of immediate enforceability of the inspector's decision, as the first proposal assumed.
The project provides for the right of the employer to appeal against the inspector's decision within 30 days to the labor court and for a faster procedure for its consideration by the court (within 30 days).
The regulation also provides for the exchange of information and data between ZUS, PIP and KAS, as well as the possibility for PIP to carry out remote inspections. It also assumes increased penalties for offenses against employee rights.

The government adopted a draft amendment to the Act on the National Labor Inspectorate, which implements the reform included in the National Labor Inspectorate, said government spokesman Adam Szłapka after the meeting of the Council of Ministers. The proposed solutions include: strengthen the effectiveness of PIP in the fight against the so-called rubbish employment – the Ministry of Labor and Social Policy said in a statement.
“The government has adopted a draft act amending the Act on the National Labor Inspectorate and certain other acts. This is a draft that strengthens the effectiveness of protection and control over compliance with labor law. The new regulations are intended to better protect employees' rights and limit the abuse or use of the so-called fictitious contracts, e.g. civil law contracts, and are also intended to improve work between public institutions,” said Szłapka.
He emphasized that these solutions implement the reform included in the National Reconstruction Plan.
“These solutions boil down primarily to granting the National Labor Inspectorate the power to change apparent civil law contracts. Of course, this is not a right that is not subject to control. In such a situation, an appeal may be made to the labor court. The courts that will deal with this will be – in accordance with the talks between the Ministry of Labor and Social Policy and the Ministry of Justice – significantly strengthened,” he noted.
He added that while the appeal is being considered, the court will be able to grant injunctive relief if it considers it appropriate.
