Unfit reservists, mobilized last year. How the legislation was changed

During last year's mobilization, several people with different degrees of disability or unfit to perform any military service were called to the “Mobex Sb-Ms 25” exercise, being informed that, in case of non-appearance, they could be fined between 1,300 and 3,800 lei.

The cases were reported especially in the counties of Sibiu and Mureș, according to some petitions addressed to the People's Advocate, an institution that found that there was no legal framework that could be used to determine the inability of reservists to participate in military exercises.

“There is thus a “legislative vacuum” that leaves them (reservists – n. ed.) without a clear answer regarding their medical condition and, implicitly, the participation in the convocations organized by the Ministry of National Defense on the occasion of the reservist mobilization exercise “Mobex Sb-Ms 25”.

In fact, it is stated that, together with the summons sent to the reservists, from the counties of Sibiu and Mureş, reservists who have certain serious medical conditions, which no longer allow them to fulfill the requirements set out in the mobilization exercise to which they are summoned, received a summons order”it is stated in a report of the People's Advocate.

According to the document, the reservists in question addressed the nearby military hospitals, asking them to issue documents showing that they cannot participate in the execrations organized by the MApN.

“For reservists and grads, there is currently no legislative framework that allows medical evaluation by these commissions. Affected persons are put on “waiting position” in the mobilization plans, until the appropriate regulations are adopted. In this sense, the Medical-Military Expertise Commission of the “Dr. Alexandru Augustin” Military Emergency Clinical Hospital Sibiu confirmed that, after the publication of the new medical scale in the Official Gazette in 2023, reservists can no longer be evaluated to determine their military fitness, even if they have obvious medical problems. According to the current legal situation: Order of the Minister of National Defense M.72/2002 regarding the approval of the Medical Scale for establishing the fitness to perform military service, with the subsequent amendments and additions that also included references regarding reservists, was repealed“, the document states.

How the legislation was changed

The People's Advocate addressed the Medical Directorate of the MApN, who informed him that an interministerial working group had been set up to resolve this situation.

The working group was attended by representatives of the co-signatory ministries (respectively MAI, SRI, SIE; SPP, STS, ANP, MJ), who discussed the introduction of a new article in the project for the modification and completion of Order no. M 194/2022 for the approval of the medical scale regarding the performance of the medical examination for admission to the military, intelligence, public order and national security education units/institutions, during the schooling of pupils and students in the military, information, public order and national security education units/institutions, for the occupation of the positions of soldier/professional graduate, as well as for the candidates who are to be called/recalled/recruited/recruited among active military personnel/policemen on duty/penitentiary policemen, regarding the reservists who had the status of military in the term.

Thus, in the framework of the new article, citizens from the general/operational reserve who are assigned to the degree of disability by the social insurance expert doctor, will have their medical-military fitness determined in accordance with the degree of disability as follows:

a) for the III degree of disability, the aptitude is “Unfit for peace, fit for war limited” (IPALR);

b) for degree II or I, the medical-military aptitude is “Unfit with removal from records” (ISE).

The regulatory process involves going through several legal and administrative stages, which is why its completion requires a certain period of time. The People's Advocate institution has assessed that it is necessary to continue monitoring the situation”, it is specified in the report.

MOBEX took place between October 12-20, 2025 and in Bucharest and Ilfov

Between October 12-20, 2025, in the city of Bucharest and in the county of Ilfov, the MOBEX B-IF-25 mobilization exercise was held to check the state of preparation of the population, the economy and the territory for defense, organized and led by the Ministry of National Defense, in cooperation with the National Administration of State Reserves and Special Issues, the Ministry of Internal Affairs, the Romanian Intelligence Service, the Special Telecommunications Service and the National Administration of Penitentiaries.

The MOBEX exercises are carried out regularly and aim to check the personnel and technical completion of the military units, as well as to strengthen the cohesion between the reservists and the active military.

The reservists residing in the city of Bucharest and in the county of Ilfov, who were summoned to the MApN units where they are stationed, participated, for one day, in specific training activities.

Similar exercises were held in Bucharest city and Ilfov county in 2013 and 2021, respectively. This year two other MOBEX exercises took place, in May, in Teleorman, Giurgiu and Olt counties, and in September, in Sibiu and Mureș counties.
