Poland has an agreement with the EC on the new version of the draft Act on the National Labor Inspectorate – announced Jan Szyszko, deputy head of the Ministry of Regional Development, on Platform X.


“We have an agreement. We have finished negotiations with the European Commission. The new PIP Act meets the requirements of the KPO, protects employees, and increases the legal security of employers,” he wrote.
In the last days of January, the Ministry of Labor prepared a new version of the draft Act on the National Labor Inspectorate.

At the beginning of January, Prime Minister Donald Tusk announced that work on the National Labor Inspectorate reform project prepared by the Ministry of Labor and Social Policy would not be continued. In his opinion, excessive power for officials introduced by the reform would be destructive for companies and would mean many people losing their jobs. The project included, among others: enabling district inspectors to change contracts for specific work, mandate contracts or B2B contracts into employment contracts.
Giving PIP these rights is one of the so-called milestones, the implementation of which determines the payment of funds from the National Reconstruction Plan. Poland has time to implement the EU directive until June 30 this year.
As stated, in the new draft act, the main assumption of the draft is to equip the labor inspector with the competence to oblige the parties to a given legal relationship to bring it into compliance with applicable legal provisions, in a situation where, during the inspection, it is determined that this relationship has characteristics typical of an employment relationship within the meaning of Art. 22 § 1 of the Labor Code, or when other violations of labor law provisions are found.
