The Court of Appeal dismisses the appeal of the Office of Competition and Consumer Protection. Eurocash will not pay the PLN 76 million fine

The Court of Appeal dismissed the appeal of the President of the Office of Competition and Consumer Protection regarding the imposition of a PLN 76 million fine on Eurocash for the use of practices unfairly using contractual advantage, consisting in requiring fees from suppliers of agricultural or food products for certain services – the company said in a press release.


As reported, the Court of Appeal in Warsaw issued a judgment dismissing the appeal of the President of the Office of Competition and Consumer Protection against the judgment of the Court of Competition and Consumer Protection of February 19, 2024. In the judgment of February 19, 2024, the Court of Competition and Consumer Protection repealed in its entirety the decision of the President of the Office of Competition and Consumer Protection of November 30, 2021, according to which the President of the Office of Competition and Consumer Protection imposed a fine on the company in the amount of PLN 76 million.
As a result of the dismissal of the appeal of the President of the Office of Competition and Consumer Protection, the judgment of the Court of Competition and Consumer Protection has become finaland the above-mentioned the decision of the President of the Office of Competition and Consumer Protection was validly annulled.
The President of the Office of Competition and Consumer Protection may file a cassation appeal against the judgment of the Court of Appeal.
As reported in February 2024, the Court of Competition and Consumer Protection fully overturned the decision of the Office of Competition Protection to impose a PLN 76 million fine on Eurocash.
In November 2021, the Office of Competition and Consumer Protection (UOKiK) imposed a fine of PLN 76 million on Eurocash for using practices that unfairly use contractual advantage, consisting in requiring fees from suppliers of agricultural or food products for certain services. Due to the decision of the Office of Competition and Consumer Protection, the company did not create any provisions. (PAP Business)
