Danileț criticizes the way in which he proceeded in the case of the 13-year-old child involved in the crime in Cenei. “It was done illegally”

Former judge Cristi Danileț complained, on Monday, that the authorities did not proceed legally in the case of the 13-year-old child involved in the crime in Cenei, who was released after killing Mario Berinde.

“The Timiş Prosecutor's Office issued a press release saying that the 13-year-old minor involved in the crime in Cenei was placed under supervision by the Child Protection Commission. That is, he was left in the care of the family. If so, it was done illegally”wrote Cristi Dănilet on his Facebook page.
The former judge argued that art. 86 of Law no. 272/2004 – invoked by the Timiş prosecutors – stipulates that the minor should have been placed in a specialized center.
“The law on the child says that for very serious acts – premeditated murder obviously falls into this category – the child must be placed in a specialized center subordinated to the DGASPC”the former judge also sent.
The minor is not criminally responsible according to the current legislation, but his presence in the community caused a riot.
According to some sources, on Sunday evening the minor was picked up by the authorities and taken, together with his mother, to a center of the General Directorate of Social Assistance and Child Protection, where he is currently in isolation. Assessments for possible substance use began upon his arrival at the facility.
Also on Monday, the Minister of Justice announced in a post on Facebook that he ordered the creation of a working group within the Ministry of Justice to analyze the opportunity to change the conditions of criminal liability of minors, including under the minimum age provided by law.
“The working group will send collaboration invitations to several judicial, medical institutions and organizations, professional associations and other components of civil society. We aim to find professional and appropriate answers through debate as quickly as possible. The problem of crimes committed by minors is one of great social responsibility as young people are the future of our society. The law must follow the evolution of the collective and the individual, including minors, in the context of social, economic, technological and mentality. However, it must take into account not only the component of criminal sanctions but also that of prevention and education or the identification of extra-penal corrective measures”Minister Radu Marinescu said.
