The Sverdlovsk District Court of Krasnoyarsk overturned the magistrate's decision to deprive a motorist of the right to drive a vehicle for violating traffic rules, considering it insignificant.
It was established that on October 31, 2025, the driver of a Toyota Corolla Fielder hit a pedestrian on Gladkov Street and left the scene of the accident. The magistrate found him guilty under Part 2 of Art. 12.27 of the Code of Administrative Offenses of the Russian Federation and deprived of his rights for a period of one year.
During further proceedings, the pedestrian stated that he did not want the driver to receive such a punishment, given that the damage was insignificant – there were no consequences from the injury. He also explained that when crossing the road he saw a moving car, but it was dark on the street, the lighting was weak, he was walking in dark clothes and the driver did not notice him.
“Sverdlovsk District Court took into account the circumstances that the act committed by the driver and the very fact of leaving the scene of the traffic accident did not entail harmful consequences; no harm to health or major damage was caused to anyone as a result of the accident; there was no significant violation of protected public relations. Based on the position of the victim, who did not ask for a strict punishment, associated with deprivation of the right to drive a vehicle, and Considering that the driver had not previously been brought to administrative responsibility, the court concluded that there were grounds for recognizing the offense as minor. The decision of the magistrate was canceled, the proceedings in the case were terminated,” said the joint press service of the courts of the Krasnoyarsk Territory.
