Decisive day at the Bucharest Court of Appeal. The court decides the situation of the two CCR judges contested by the AUR lawyer, Silvia Uscov

The Bucharest Court of Appeal is expected to announce today, at 9 o'clock, whether it suspends the acts by which CCR judges Dacian Dragoș and Mihai Busuioc were appointed. The decision that the court will pronounce is not final, but it can be enforceable, which could lead to the suspension of the CCR magistrates in case of admission. Also today, at 10 o'clock, the CCR meets for the fourth time to give a decision on the magistrates' pensions.

Judge Olimpiea Crețeanu from the Bucharest Court of Appeal is the one who will decide whether to suspend the acts by which President Nicușor Dan, respectively the Senate of Romania, appointed Dacian Dragoș and Mihai Busuioc as judges at the Constitutional Court.

On Thursday, another panel within the CAB rejected the request of the Presidential Administration regarding the recusal of Judge Crețanu. This had a hostile attitude towards the lawyer of the Presidential Administration, threatening him with the eviction from the room at the deadline of January 5.

Judge Olimpea Crețanu is the one who acquitted, in 2013, the businessman Ioan Niculae and the head of Brăila CJ, Gheorghe Bunea Stancu, in the “Bribery to PSD” file.

The decision expected today comes a day after new accusations by the lawyer Silvia Uscov, who initiated the trial against the two CCR judges.

On Thursday, lawyer Uscov presented a series of documents that show that judge Dacian Dragoș, in parallel with his position at the CCR, appears as an administrator at a joint-stock company in Cluj Napoca.

Dacian Dragoș explained to HotNews that he resigned from that position, before being appointed to the CCR, but he does not know if the General Meeting of Shareholders communicated this to the National Office for the Trade Registry, as required by law.

The unprecedented action against CCR judges

Lawyer Uscov asked the Bucharest Court of Appeal to suspend the acts by which Mihai Busuioc and Dacian Cosmin Dragoș were appointed judges at the Constitutional Court, on the grounds that they do not meet the condition of 18 years of age in the legal field required by the Constitution

Silvia Uscov's referrals, registered on December 30 and 31 at the Bucharest Court of Appeal, received a quick deadline, compared to other similar files.

In addition to the two lawsuits opened against the two CCR judges, Silvia Uscov also sued the Government of Romania on the last day of 2025, requesting the suspension of Prime Minister Bolojan's decision on the establishment of the committee for the analysis and review of legislation in the field of justice.

Dacian Cosmin Dragoș said, for HotNews, that there are no doubts regarding the fulfillment of the legal conditions and that, in fact, this approach is being introduced “at an obviously strategic moment”.

The CAB's decision is enforceable, even if it is not final

The decision that the CAB will pronounce today will not be final, but the judge can order it to be enforceable, explained several lawyers consulted by HotNews.

This means that in the event that the referrals are admitted, until the merits of the case are settled, the effects of the decisions by which judges Dragoș and Busuioc were appointed are suspended, a situation that would lead to their suspension from office.

Decisive day at CCR too

CCR judges will meet today to debate again the law on the service pensions of magistrates.

This is the fourth meeting of the CCR on this referral, after delays caused by the boycott of the four constitutional judges appointed to the PSD proposal.

It is very likely that the CCR will postpone taking a decision even today, according to HotNews sources, after the High Court of Cassation and Justice announced on Thursday that it submitted an accounting expertise to the CCR, which shows that the new law cancels service pensions.
