Act on the National Council of the Judiciary and the rule of law. Waldemar Żurek announces an important day


On Monday, the Minister of Justice announced that the government would have its hands full before Christmas. On Tuesday, the Council of Ministers will deal with two – as he put it – fundamental projects prepared by the Ministry of Justice – the Act on the National Council of the Judiciary and the so-called the Rule of Law Act.

Waldemar Żurek: repairing what was broken
Minister Żurek emphasized that the pace of legislative work is very fast, but as he noted, he committed to preparing the projects this year.

“One of the acts, which we call the rule of law, concerns the improvement of the situation related to the so-called neo-judges and repairing what has been broken. The second act concerns the National Council of the Judiciary” – pointed out the head of the ministry.
The draft Rule of Law Act was adopted by the Standing Committee of the Council of Ministers in early December. The new regulations aim to restore the right to an independent and impartial court by regulating the effects of resolutions of the National Council of the Judiciary adopted in 2018–2025.
Act on the National Court Register and the so-called rule of law act. What are they about?
The main assumptions include repeating competitions for judge positions filled with the participation of the National Council of the Judiciary in its current form and restructuring the status of judges appointed in 2018–2026. A special procedure is also provided for questioning certain judgments issued with the participation of a judge appointed from 2018 – at the request of a party, the decision is to be automatically annulled.

The draft amendment to the Act on the National Council of the Judiciary, which provides for the election of judicial council members by all judges, was submitted for consultation and review in November. As emphasized by the Ministry of Justice, the key change is the introduction of direct elections of 15 judges to the National Council of the Judiciary by all judges in Poland. Each judge will be able to cast up to 15 votes for candidates from different levels of the judiciary. The National Electoral Commission will be responsible for conducting the elections.
Before 2018, members of the National Council of the Judiciary were elected by general assemblies of judges. After the changes introduced by the PiS government, the election is made by the Sejm.
