Ponta informs Nicușor Dan that Radu Miruță, proposed by the USR as Minister of Defence, is incompatible. “It is likely to make MApN seriously vulnerable!”

Former Prime Minister Victor Ponta announced on Thursday that he is officially notifying President Nicusor Dan and the Prime Minister about the incompatibility of Radu Miruţă, proposed by the USR as Minister of Defense.

Victor Ponta signals on Thursday, December 18, the fact that Radu Miruţă, proposed by the USR as Minister of Defense, is in a state of incompatibility, which “is likely to seriously undermine the Ministry of National Defense and government activity!”.

“Official notification to the President of Romania and the Prime Minister of the Government of Romania regarding the state of legal incompatibility of a person proposed for the position of minister in a strategic field and Deputy Prime Minister – respectively Mr. Radu Dinel Miruţă!

I hereby inform you of the existence of a state of legal incompatibility in the case of a person proposed for the position of minister. This incompatibility is likely to make the Ministry of National Defense and government activity seriously vulnerable!”, the former prime minister began his message.

Victor Ponta attached some documents to his post which, according to him, demonstrate the incompatibility of Radu Miruţă. He indicates that he was validated as a deputy on 21.12.2020, the date on which he held a PFA in his name, which is against the legislation in force, and was suspended as incompatible only 3 years later, all this time the company was active.

“In this regard, I am attaching the official address of the National Integrity Agency (ANI), which explicitly states that:

“Exercising the capacity of a deputy and that of an authorized natural person (PFA) generates a situation of incompatibility from the perspective of the provisions of art. 82 para. (1) lit. e) from Law no. 161/2003 and of art. 16 para. (1) lit. a)–e) from Law no. 96/2006, with subsequent amendments and additions.»

I am also attaching the official address issued by the National Office of the Trade Register, from which it follows that Mr. Radu Miruță was registered as an authorized natural person during the period in which he exercised the mandate of deputy.

I am also attaching the Decision of the Ministry of Justice dated 11.04.2023 which stipulates “Mr. Miruță Radu-Dinel, judicial technical expert in the specializations Computers, Electronics, Informatics and Telecommunications Networks and Software, is suspended, upon request, as a judicial technical expert, for INCOMPATIBILITY”.

I specify that Mr. Radu Miruţa was validated as a deputy on 21.12.2020 and was suspended for incompatibility by the MoJ with a delay of over 3 years!

I appeal to all independent journalists who are not part of the Propaganda NETWORK to study the documents and do their own investigation to certify the legal and political reality!

I consider it essential that ANI and the Judiciary are allowed to function independently in this case as well, as in any other similar situation. The pressure exerted by the USR on the ANI and the judicial system must not prove effective, regardless of the person concerned.

The rule of law and the rule of law must be guaranteed by the President of Romania and the Prime Minister of the Government of Romania, without exception and without discrimination, regardless of the political party from which the person in question comes. To the extent that you decide to ignore this legal situation, the rule of law in Romania will be seriously affected; and the differentiated application of the law, depending on the person, will be officially institutionalized!”, Victor Ponta wrote on his Facebook page on Thursday.

Victor Ponta's message comes in the context in which USR is to validate, on Friday, December 19, during an online meeting of the Political Committee, the nomination of Radu Mirică to the Ministry of Defense and of Irineu Darău, in his place, to the Ministry of Economy, Digitalization, Entrepreneurship and Tourism.

Asked on Thursday what he thinks about USR's nominations to the two ministries, President Nicusor Dan declared that both are people he trusts.
