Controversial moment from the press conference at the Court of Appeal, signaled by judge Cristi Danileț: “I have not found any rule that allows this”

Court regulations do not allow persons outside the case to get possession of a recording from the court session, says former judge Cristi Danileț, signaling a controversial moment from the press conference at the Bucharest Court of Appeal.
“Today, the president of the CAB and the court's computer scientist made public a recording from a court session. I did not find any rule in the internal order regulation of the courts that would allow a person outside the case to take possession of such a recording”, says Cristi Danileț in a post on Facebook.
“And there is certainly no law that allows the distribution to the public of such a recording outside of the procedural framework,” adds Danileț, who also presents the provisions of the Code of Criminal Procedure (Cpp) on how to access such recordings.
“Upon request, the parties, at their expense, can obtain an electronic copy of the recording of the court session regarding their case, except for situations where the session was not public in whole or in part,” states paragraph. (6) of Art. 369 of the Civil Code regarding the holding of the court session.

At the “extraordinary” press conference organized on Thursday by the management of the Bucharest Court of Appeal, Liana Nicoleta Arsenie, the president of the CAB, brought numerous criticisms to the judges who accused the abuses committed by the court management.
One of the persons targeted was judge Daniela Panioglu, who stated to the Euronews station that “I don't know if anything works better in Romania than judicial corruption.” Panioglu explicitly criticized the CAB management.
In response, CAB president Liana Arsenie said in the conference that “While invoking moral imperatives, Ms. Panioglu launched into the public space accusations that are not factual. She accused other people without evidence.”
“We will present the triggering factor of the conflict. Although on June 15, 2011 the judge acquired the right to own an apartment, until 2015 she continued to settle rent from the state, falsely declaring that she did not own a home. When CAB found out the reality and stopped paying the rent, the judge appealed the decision in court,” said judge Arsenie about her colleague, meanwhile excluded from magistracy.
Continuing the exposition about Judge Panioglu, Judge Arsenie also said that her former colleague also had a violent attitude. More precisely, the judge argued with a colleague “and hit him in the head with the file”.
