The ordinance would challenge state laws because they interfere with interstate commerce. Legal experts question the constitutionality of this bill.

— This is an issue within the purview of Congress, which it has considered and rejected, and should continue to reject. “This proposal is shocking because it disregards the democratic processes of state governments in their efforts to address the real and documented harms of artificial intelligence tools,” said Travis Hall of the Center for Democracy and Technology, a Washington-based organization dedicated to protecting civil rights in the digital age.

The regulation would establish a federal task force to review existing state artificial intelligence laws and assess whether they violate free speech, and the secretary of commerce would have the authority to withhold federal broadband funding for states with such regulations.

“We MUST have one federal standard instead of a patchwork of 50 state regulatory systems. If we don't, China will easily catch up with us in the race for artificial intelligence,” the president wrote on the Truth Social platform.

Some Republican governors, including Ron DeSantis of Florida and Spencer Cox of Utah, oppose federal pre-emptive action.

“Sneaking this into the defense bill is an insult to voters,” DeSantis said on the X platform.
