The Minister of Justice, de jure member of the Superior Council of the Magistracy, told G4Media on Monday evening that he did not sign the complaint against Deputy Prime Minister Oana Gheorghiu, accused by the CSM of “incitement to violence, hatred or discrimination” through statements about magistrates' pensions.
Minister Radu Marinescu explained that “the complaint is a way of reporting the criminal prosecution order that implies the existence of a personal injury”, and “the accusation of incitement to hatred or discrimination could be complained about by judges or prosecutors, but not by an administrative body”.
“Beyond that, the approach seems more like an exercise in public attitude than an actual legal act aimed at bringing criminal responsibility. The objective and subjective typicality of the accusation is debatable (…). I did not participate in the last plenary session being in the government meeting at the same time and I have no knowledge when and in what context this decision was taken, I did not vote or sign,” said the Minister of Justice, Radu Marinescu.
The official's statement comes in the context in which, on Monday, the CSM accused the Deputy Prime Minister Oana Gheorghiu of having committed an “attack” on the judicial power, through the statements about the magistrates' pensions. The institution announced that it “decided to notify the bodies empowered to carry out investigations under the aspect of committing the crime of incitement to violence, hatred or discrimination”, an unprecedented step.
In a Saturday show on Digi24, Oana Gheorghiu compared the magistrates' pension system to “a kind of Caritas” and told the employees in the sector that “if that money has to go to them because they give sentences, they get it from somewhere and can take it from the mouth of a child who goes to bed hungry”.
Contacted by HotNews on Monday, Oana Gheorghiu said that she does not comment on the CSM's approach.
