PiS MP Zbigniew Ziobro believes that the request to waive his immunity was signed by the wrong person, which is why it is legally ineffective and should not be considered. On Thursday, the Sejm Committee on Rules and Deputies' Affairs is to consider the request of the head of Investigative Team No. 2 of the National Prosecutor's Office to waive the immunity and provisional arrest of the former head of the Ministry of Justice, PiS MP Zbigniew Ziobro. The case concerns the Justice Fund. According to the prosecutor's office, there is a reasonable suspicion that Ziobro committed 26 crimes, including founding and leading an organized criminal group in the Ministry of Justice, which misappropriated over PLN 150 million from the SF.
Ziobro stated on Tuesday, in a post on the X platform, that “the request of the National Prosecutor to waive his immunity was signed by another personand Minister Żurek, by sending a letter to the Sejm, certified an untruth.” “I submitted a report on the suspicion of committing a crime by Żurek, as well as by Prosecutor Piotr Woźniak, who signed a document that was not his own. Such a request is ineffective under the law and should not be considered,” said the former Minister of Justice.
He posted on X the notification that he and another PiS MP, Marcin Warchoł, submitted to the prosecutor's office on behalf of the PiS club. In the notification, both claim that the request to the Sejm for the waiver of immunity and temporary detention suggests that the applicant is the First Deputy Prosecutor General of the National Prosecutor, while the request is signed by Piotr Woźniak – prosecutor of the Warsaw-Praga District Prosecutor's Office.
Woźniak is the head of investigative team No. 2, established to investigate irregularities in the Justice Fund.
Ziobro and Warchoł argue in their notification to the prosecutor's office that the request to waive immunity addressed to the Speaker of the Sejm proves untruthful “as to the circumstances of Prosecutor Woźniak's function as First Deputy Prosecutor General – National Prosecutor.” According to PiS MPs, Woźniak acted for personal gain, “expressed at least in the desire to be perceived as the National Prosecutor, and perhaps also in the desire to formally assume such a function”; moreover, “he has usurped a function that he does not actually perform.”
Ziobro and Warchoł also assessed in the notification that the behavior of Prosecutor Woźniak constituted a failure to fulfill the obligations described in the Law on the Prosecutor's Office, in particular the obligation to uphold the rule of law.
In the opinion of PiS MPs, there is a justified suspicion that Prosecutor General Waldemar Żurek consciously used a false document by sending it to the Speaker of the Sejm, Szymon Hołownia. “The Prosecutor General's full awareness of the inauthenticity of the transmitted document is evidenced by Waldemar Żurek's letter of October 30 addressed to the Speaker of the Sejm, in which he de facto admits that the request to waive parliamentary immunity was signed by a person other than the National Prosecutor – explaining it as… a mistake,” PiS MPs wrote in the notification.
In their opinion, Waldemar Żurek's behavior is also a failure to fulfill the obligations described in the Law on the Prosecutor's Office, in particular the obligation to uphold the rule of law and the obligation to supervise the conduct of preparatory proceedings in criminal cases. (PAP)
