The plant illegally privatized the building of a kindergarten in Krasnoyarsk

In Krasnoyarsk, the court returned the building of a kindergarten on the street to municipal ownership Dzhambulskaya, 13.

The prosecutor's office checked the legality of the administration's conclusion of a lease agreement for the premises and found out that in 1993 the regional committee for state property management illegally included the property in the authorized capital of the Korkinsky large-panel house-building plant. This entailed the subsequent registration of the joint stock company's private property rights to it. Then the director of the plant transferred the kindergarten to his son to pay off the accounts payable to him.

“During the privatization of a social facility, the law was grossly violated: the plant could not use the kindergarten for its intended purpose, which means its alienation was illegal. At first, the municipality used the building for free for the same purposes for 14 years, after which it was forced to enter into a lease agreement with the owner for a monthly fee of 700 thousand rubles from the city budget,” the supervisory department said.

The prosecutor's office filed a lawsuit demanding that the privatization be declared invalid and that the kindergarten building be returned to municipal ownership. The court of first instance refused this on the grounds that the statute of limitations had expired, but the higher court upheld the appeal and decided to remove the object from illegal possession, cancel the entry in the Unified State Register of Real Estate and return the building to the city.

The execution of the judicial act that has entered into legal force is under the control of the prosecutor's office, and the issue of collecting unjust enrichment in the amount of 97 million rubles into the budget is being resolved.
