The coalition will meet on Tuesday in the first meeting after the decision of the Constitutional Court to reject the law on the amendment of the magistrates' pension system, announced Sorin Grindeanu. Asked if, in his opinion, the resignation of Ilie Bolojan is required, the PSD leader said that the prime minister should not leave.
The president of the PSD, Sorin Grindeanu, said that in the coalition meeting he will propose the formation of a working group to deal with the reformulation of the law for the reform of magistrates' pensions.
Asked if Ilie Bolojan's resignation is required, the PSD leader replied: “Unlike other colleagues in the coalition, I said from the very beginning that he should not resign, regardless of the verdict on this package.”
The Constitutional Court admitted, on Monday, the referral of the High Court of Cassation and Justice on the Bolojan Law regarding the modification of the pension system for judges and prosecutors. The decision was taken with 5/4 votes. Until now, CCR has not officially communicated the reasons why the law failed.
Sources from the CCR explained to HotNews that the reason for declaring the law unconstitutional is due to the lack of the CSM's opinion. This means extrinsic reasons, i.e. of form, and not of substance (regarding the content of the law), and under these conditions the procedure for adopting the Law of the Bologna Government could be resumed.
Until now, Prime Minister Bolojan has not reacted. The spokeswoman of the Government, Ioana Digoiu, said that the Government will issue a point of view after the Constitutional Court sends the communiqué by which it will officially make the announcement regarding the declaration of the law as unconstitutional.
On September 2, a day after pledging the Government's responsibility in Parliament on the package of measures, Prime Minister Ilie Bolojan was asked by HotNews in a press conference if he would resign if the draft law on magistrates' pensions failed at the CCR.
“When you have an important project that is a milestone for making other similar decisions, if it doesn't pass, it's hard to assume that the Government still has the legitimacy to come up with similar measures in other areas,” answered Bolojan.
