In the Krasnoyarsk Territory, the prosecutor's office succeeded in declaring a “fragmented” contract for road repairs in Lesosibirsk illegal.
The department said that in the village of Mirny they planned to repair a section of the road 600 meters long. The cost of the work was estimated at 6.3 million rubles. This required bidding, but the capital construction department decided to bypass this requirement.
“During a routine inspection, the prosecutor’s office found out that the department had entered into 11 contracts with one entrepreneur from Lesosibirsk for the repair of the same section of the road. Each of the documents was devoted to the repair of exactly 55 m of a single road surface. All of them were signed on the same day, had identical conditions and deadlines, and their cost did not exceed 600 thousand rubles», — explained the prosecutor's office.
The prosecutor's office filed a lawsuit with the Arbitration Court demanding that all transactions be declared invalid and that illegally obtained money be recovered from the contractor.
The court fully satisfied the requirements of the supervisory agency. All concluded contracts were declared illegal, and the entrepreneur was obliged to return the funds received to the budget.
