The Polnord scandal. Giertych: Ziobro and Święczkowski should pay me compensation

KO MP Roman Giertych assessed that the amount of compensation awarded to him for the arrest of the Polnord case should be collected from former head of the Ministry of Justice Zbigniew Ziobro and former national prosecutor Bogdan Święczkowski. He added that he would submit a report to the prosecutor's office against the CBA officers who detained him.


The Court of Appeal in Warsaw awarded Roman Giertych PLN 35,000 on Wednesday. PLN compensation from the state for being detained by the Central Anticorruption Bureau in October 2020. She informed about it, among others: “Gazeta Wyborcza”. Giertych demanded half a million zlotys in compensation. In the first instance judgment issued two years ago, the court awarded him PLN 20,000. zloty. Sthe court found that his detention was “illegal”, “unjustified” and “undoubtedly wrong”. The Court of Appeal increased compensation amount up to PLN 35,000 zloty. The judgment is final.
Giertych was detained by the CBA on October 15, 2020 in connection with an investigation regarding the removal and misappropriation of a total of approximately PLN 92 million from the listed development company Polnord. Giertych previously served as the company's representative.
A lawyer and KO MP assessed during Friday's press conference in the Sejm that Prosecutor General Waldemar Żurek should submit a recourse claim to Zbigniew Ziobro and Bogdan Święczkowski for payment of the compensation awarded to him from the State Treasury.
As Giertych argued, in accordance with the Code of Criminal Procedure, in a situation where the State Treasury must pay compensation to a detained person, it is entitled to a recourse claim, i.e. a recourse claim to the people who made the decision. He noted that although the formal decision regarding his detention was made by prosecutor Marcin Jędruszczak from the Regional Prosecutor's Office in Poznań under the supervision of the regional prosecutor, – as the KO MP argued – the files of the proceedings show that all decisions in this case were consulted with Święczkowski and Ziobro.
– In this situation, I believe that the prosecutor general has not only the right, but also the obligation to submit a recourse claim to these two gentlemen for appropriate payment. Perhaps in solidarity with the prosecutors who directly made the decision in this case – said Giertych.
He also informed that he was reporting to the prosecutor's office against the CBA officers who detained him. – Artur Chudziński and Wojciech Murawski will be the principal persons named in this notice.
I think they should increase criminal liability for exceeding their powers and failing to fulfill their duties, said Giertych.
In January this year The Regional Prosecutor's Office in Lublin discontinued the proceedings in the Giertych case; According to investigators' findings, no crime was committed. (PAP)
