A cadastral engineer from Berezovka will spend 10 years in prison for fraud with land

In the Krasnoyarsk Territory, a court sentenced a cadastral engineer and his accomplice for fraud with municipal land in Berezovka. The regional prosecutor's office reported this.
It all started in 2018, when the wife of a local official decided to use the services of a cadastral engineer. She asked to form and register two plots of agricultural land with an area of 39.7 thousand square meters. and 90.9 thousand sq.m. The engineer agreed, carried out cadastral work, drew up technical plans and sent applications on her behalf to the administration to formalize a lease for the land.
When the documents were signed and the land was provided for livestock purposes, the woman brought concrete blocks to the plots, and on them she erected two transformer substations 15-20 m from each other. The substations were of dubious quality and inoperative. However, the cadastral engineer regarded them as non-residential buildings and created declarations and technical plans for real estate objects for them.

“He “did not notice” that the lands were empty and were not used for their intended purpose, and once again drew up an application on behalf of his ward for the provision of land, now for ownership, at a preferential price. With the help of a cadastral businessman, for just 23 thousand rubles, a woman became the owner of a huge land plot with an area of 130 thousand square meters,” the prosecutor’s office said.
However, the deal did not pass the prosecutor's review. When the threat of land seizure took on a convex form, the woman’s husband turned to his entrepreneur friend and asked to re-register the land in his name. He, unaware of the criminal land scenario, agreed. But having received a subpoena based on the prosecutor’s claim, he hastened to cancel the deal.
At the request of the prosecutor, the lands were returned to the municipality. The defendants did not admit guilt and provided additional expertise on the lower market value of the plots. The specialist insisted on the capital construction of the buildings on the site, and his accomplice referred to a lack of knowledge in the field of land relations.
The court reclassified their actions and sentenced the cadastral engineer for fraud (Part 3 of Article 159 of the Criminal Code of the Russian Federation) to 10 years in prison to be served in a general regime colony, and his accomplice to 3.5 years of suspended imprisonment with a probationary period of 3 years.
