In Minusinsk, the developer started the case for the illegal collection of money for shared construction of the house

In the Krasnoyarsk Territory, a criminal case was opened on the fact of the illegal attracting money of citizens for shared construction of an apartment building, the regional investigative department of the IC of the Russian Federation said.

According to investigators, in December 2023, the construction company received permission to build a 9-story building in Minusinsk on Tregubenko Street. It should be handed over in March 2026.

To finance construction, the head of the company decided to use the funds of equity holders, which is prohibited by law until the house is put into operation. To get around this ban, the developer decided to give transactions the visibility of the rule of law.

“He concluded with another company more than 50 shared participation agreements in the construction of a house worth more than 87 million rubles. Then this organization entered into agreements by the transfer of the right to claim 37 to citizens under shared construction contracts for a total of at least 150 million rubles“, – They told the investigation department.

The prosecutor’s office clarified that the “technical” contracts of shared participation were concluded at a deliberately low price – only 20 thousand rubles per square meter. Then the developer transferred the rights to 37 to citizens already at the market value, which turned out to be 3.5 times higher than the initial.

“Bypassing the special secure escrow accounts, all this money entered the calculated accounts of the developer. In the event of a breakdown of construction, citizens could lose both housing and money, ”the press service of the supervisory authority noted.

On this fact under Part 2 of Art. 200.3 of the Criminal Code of the Russian Federation opened a criminal case on attracting funds of citizens on an especially large scale in violation of the requirements of the legislation of the Russian Federation on participation in shared construction of apartment buildings.

Currently, investigators are conducting the necessary investigative actions aimed at establishing all the circumstances of the crime committed. After the prosecutor’s check, the first stage of the house was commissioned. Already more than 60 families received the keys to their apartments.
