Legal stay of Ukrainians in Poland extended. New rules

Ukrainians staying in Poland will be able to remain here in accordance with the law. The amendment to the regulations has just entered into force, which extends their legal stay in our country until March 4, 2026.

The amendment to the Act on the aid of Ukrainian citizens entered into force on September 30 this year. Thanks to this, the following have been extended:

• validity of domestic visas, temporary permits and cards of the residence of Ukrainian citizens,
• deadlines for leaving Poland and a voluntary return,
• The validity of documents such as the Polish identity document of a foreigner or “consent to tolerated stay”.

This means that Ukrainians benefiting from temporary protection will still not have to submit new applications to maintain a legal stay in Poland.

Changes in the legalization of the stay

The amendment also introduces additional rules. One of them is that The Ukrainian stay will be considered legal until the application for a residence card is considered if it is submitted by March 4, 2026. In addition, Ukrainians conducting business activity on the basis of an entry in CEIDG do not have to meet the standard requirements regarding the scale and quality of activities when applying for a temporary stay. The new regulations also allow not to be remedied or to relieve proceedings regarding the obligation of Ukrainians to return.

It is not worth entering into marriage to circumvent the law

The new regulations limit the possibility of obtaining a temporary residence permit based on the so -called a special law only up to once. They also introduce additional conditions for withdrawing such a permit, among others in the event of submitting false data, using counterfeit documents or marriage to circumvent the law.

Earlier provisions regarding the cards for the stay of valid 3 years have been modified. To be able to receive them, Ukrainians must have a PESEL number with the “UKR” designation on June 4, 2025.

The solutions just being introduced are to ensure the continuity of Ukrainians' stay in Poland and facilitate their further legalization of the status in the face of the ongoing war.

Ukrainians are waiting for more changes

On Friday, the president signed a law on helping citizens of Ukraine, which seals the system of receiving benefits for family by foreigners. The right to these benefits was associated with the parent's professional activity and the education of children at a Polish school, with the exceptions about, for example, people with disabilities. In addition, the right to benefits will be related to foreigners obtaining at least 50 percent. minimum remuneration for work, which means that in 2025 it will be PLN 2333 gross.

He admitted that “the law is not perfect” and the presidential project proposed better, “even more sealing this system” solutions.
