To three years and six months in prison, the District Court in Kalisz developer Sebastian O., who deceived 42 families and 11 subcontractors. The verdict is unlawful.

According to the Court, the developer misled buyers of apartments as to the possibility of fulfilling the acceptance. He led them to an unfavorable disposal of property, because the victims gave him money for the implementation of the investment, which he did not make.
The accused was perfectly aware of the financial situation of his company and his obligations, yet he undertook another investment. Each subsequent one was to save the previous one – said judge Urbaniak.
According to the Court, the accused, taking unlawful actions, wanted to save his company at the expense of the victims.
– The accused of his actions created a false sense of his credibility from buyers and subcontractors. He used the ignorance of the victims – the judge emphasized.
The accused faced up to 10 years in prison. The prosecutor and the auxiliary prosecutor of the victims demanded four years in prison, a fine, an obligation to repair damage to the victims and 10 years of ban on conducting business activity. The defender applied for acquittal.

The developer posted an announcement that serial houses would be built to us. The investment was to be completed in 2018. The entrepreneur did not finish the investment, and the families who paid money were in a dramatic situation.
The case went to the Vocabula in June 2023. The prosecutor accused the accused of a fraud to the detriment of buyers of apartments and contractors implementing the construction, failure to file for bankruptcy of the company he represents and to conceal information about the obligation to accept payments to an open housing confidance account. The man did not confess to the alleged acts. In the prosecutor's office, he stated that the company's problems were caused by an increase in prices for building materials, which he could not predict.
For the threatening obligation to compensate for damage to the victims, the prosecutor took shares in a company accused of PLN 175,000. PLN and two villas in the amount of PLN 2.7 million. The losses suffered by 42 injured families are almost PLN 10 million. Residents intended to take over the investment and find a new developer, but no one wanted to complete the construction.
When other creditors began to enter the property, Karolina Skrzypczyńska, to whom they asked for help, she convinced the buyers of the apartments that the best solution would be to conduct bankruptcy proceedings. He managed to convince the trustee not to sell the housing estate for a slice, but he completed a developer undertaking.
Thanks to the help of the city authorities, the investment was completed by the Kalisz Towarzystwo Budownictwa Społecznego Sp. The costs of completing the construction were covered by the buyers. On average, the family had to add 100,000 after PLN to the apartment.
At the end of 2022, they signed notarial acts and moved into their homes.
