Compensation for damage to health. Who is entitled to and how to get them?


The amount of compensation is proportional to the percentage of health. For example, a person whose damage has been rated at 10 % will receive PLN 16,360. The key element of the process is the opinion of the certifying doctor, which is issued only after the end of treatment or rehabilitation.
The damage to health is defined as a permanent or long -term violation of the body's fitness, which may hinder the performance of daily activities or professional duties.
Not every injury qualifies as a damage to health. For example, if you experience bruises or minor injuries as a result of an accident at work, which will go away in a few weeks, this will not be considered as damage.
The situation is different in the case of more serious injuries, such as fractures. If injuries require surgery, rehabilitation or lead to lasting restrictions, such as deformations or, for example, limiting joint mobility, they can be classified as damage to health.
Compensation for damage to health in 2025.
The amount of compensation for accidents at work is regularly updated. The increase in 2025 is another step in adapting benefits to changing economic realities.
The amounts of disposable compensation for damage to health caused by an accident at work or an occupational disease are given by the announcement of the Minister of the Family, Labor and Social Policy of February 28, 2025. In the period from April 1, 2025 to March 31, 2026, examples of amounts are:
– PLN 1,636 for each percentage of permanent or long -term damage to health;
– PLN 28,636 due to a total incapacity for work and inability to independently exist the insured;
– PLN 147,271, if a one -off compensation is entitled a spouse or child of the deceased insured or a pensioner;
– PLN 73,635, If a member of the deceased insured or a pensioner other than a spouse or child is entitled to a one -time compensation;

The percentage assessment is an attachment to the regulation on detailed rules for adjudicating on permanent or long -term damage to health (Regulation of the Minister of Labor and Social Policy of December 18, 2002). An example of compensation entitlement may be:
– balance disorders of cerebellar origin preventing walking and independent functioning – percentage assessment: 100 percent – compensation: PLN 163,600
– Loss of one auricle – percentage assessment: 15 percent – compensation: PLN 24,540
– full foot loss – percentage assessment: 50 percent – compensation: PLN 81,800
– Loss of the lower limb by deducting in the abdomen – Percentage assessment: 85 percent – The amount of compensation: PLN 139 060
