The District Court in Warsaw decided that the former Minister of Justice Zbigniew Ziobro persistently avoids appearance before the Pegasus committee – the spokeswoman of the court Anna Ptaszek donated. She also added that the police are to lead him to the commission on September 29. The court's decision is entitled to a complaint.

On Tuesday, the District Court in Warsaw agreed to detention and forced bringing Ziobra, currently a PiS MP, to a meeting of the parliamentary inquiry commission for Pegasus. The committee meeting is scheduled for September 29.

The court found that these premises (…) persistent failure to appear, persistent evasion of testimony, which constitute the basis for the decision of such a measure, were met and and therefore the court took into account the request of the commission – said Ptaszek.

She also reminded that Ziobro publicly declares his lack of intention to appear before the investigation commission and did not justify his absence three times. She added that the activities are to be carried out by the police on September 29.

The police are to lead Mr. Ziobra to the meeting. Of course, we assume that it will do it without excessive repressionso as not to deprive him of his freedom for too long – the spokeswoman noted, also a judge of the Warsaw District Court.

She also referred to Ziobra's recently raised argument that the Constitutional Tribunal issued a decision in August that the courts and the Commission would stop the actions to Ziobra until the judgment of the Constitutional Tribunal of 10 September 2024, in which the establishment of the Pegasus Commission was considered unconstitutional. Judge Ptaszek emphasized that the District Court in Warsaw did not share this argument, indicating that the Court has no competence to interfere in the decisions of common courts and does not constitute a “super”.

The spokeswoman also informed that from Tuesday's decision he was entitled to a complaint within seven days, calculated from the delivery of a written justification. She noted, however, that the court's decision is enforceable.

Ziobro before the Pegasus committee

The Commission has been wanting to question Ziobra for over a year in connection with the use of Pegasus software for surveillance, including political opponents. The Commission initiated the current procedure at the end of June in connection with the next, eighth, absence of Ziobra in the interrogation. As a result, the Sejm on July 25 agreed to his detention and forced bringing to a committee meeting.

The former minister, like other PiS politicians, believes that the Sejm inquiry commission for Pegasus operates illegally, justifying this by the judgment of the Constitutional Tribunal of September 10 last year. stating that the resolution of the Sejm about the establishment of this committee is unconstitutional.

A similar procedure has already taken place this year. On January 31, the police detained Ziobra after an interview on TV Republika, but he did not manage to meet the investigation committee. The commission considered the bringing to be ineffective and applied for arrest up to 30 days, which the court did not take into account.
