The Superior Council of Magistracy, appeal to politicians for “responsibility in the speeches and messages transmitted to prevent the establishment of a social chaos”

On the day when Prime Minister Bolojan assumes responsibility in Parliament for five of the six projects in the fiscal package 2, among which the one regarding the modification of the Special Pension System, the Superior Council of Magistracy (CSM) accuses that the public messages he transmitted “have been ignored, and the denigration campaign continued and generated a consequences”.
In a statement sent on Monday, the SCM says that “in the context of the campaign to defam the magistrates initiated and maintained by repeated positions in the area of the political factor and intensely promoted in the media to distract from the economic and social problems with which the society faces”, the institution “insisted the risks that such an approach generates”.
“The phenomenon of exceptional gravity, which tends to expand, are outlined in courts and prosecutor's offices.”
“Unfortunately, the public messages transmitted by the Council were ignored, and the denigration campaign continued and generated consequences that are difficult to imagine in a rule of law. Social networks abound in positions of unprecedented aggression to the magistrates, in the sense of direct instigating to commit some serious crimes or of other antisocial crimes.
Moreover, similar manifestations also took place inside the courts, even in the courtrooms, leading to the issuance of protection orders to prevent the materialization of serious antisocial facts ”, accuses the SCM.
The Superior Council of Magistracy claims that “the courts and the prosecutor's offices have reported numerous such incidents, outlining a phenomenon of exceptional gravity that tends to expand, being unprecedented and threatening the physical and mental integrity of the magistrates and members of their families”.
The SCM also says that he will notify the competent criminal prosecution bodies to do investigations regarding all the incidents reported by courts and prosecutor's office, as well as those identified in the online environment.
At the same time, the Superior Council of Magistracy addresses “a appeal to public communication vectors both from the political environment and outside it, to show responsibility in the speeches and messages transmitted to prevent the establishment of a climate of social chaos, in which the act of justice would no longer exist.”
The Superior Council of Magistracy announced on Friday, in a press release, that “during the general meetings of the judges held between August 26 and 27, 2025, the courts and courts from all over the country decided that it is necessary to adopt the same measures established by the 16 courts of appeal, requesting the entry of the law to the Emergency Project. the judicial authority, which seriously affects the rule of law, the rights and freedoms of citizens who can be effectively guaranteed only by an independent justice ”.

On August 26, the 16 courts of appeal in Romania announced that they suspend their activity to “draw an alarm regarding the major risk of destabilization of the judicial system”, generated by the change of the legal framework regarding the magistrate's service pensions.
How the Government has changed the Special Pension System
The project on the pensions of the magistrates remains unchanged compared to the version put in public debate on August 14, which has aroused harsh reactions and protests from the magistrates, which triggered the protests by suspending the activity.
If the project is adopted and passes the Constitutional Court, it will enter into force from October 1, 2025. By 2036, there are transient norms – the magistrates will be added, gradually, one year and six more months at the retirement age, that is, it will increase gradually. From 2036, the retirement age will be at 65.
The draft on the changes of the pensions of the magistrates sent for approval by the Government to the CES includes the following changes:
- Establishing the retirement age for magistrates at the standard age of the public pension system, respectively 65 years.
- To retire the magistrates will have to be 35 years old. Now, magistrates can retire if they are 25 years old.
- The pension of the magistrates will not be able to be more than 70% of the last net salary collected. Now, it is 80% of the last gross salary collected.
- For the magistrates who are currently in office: the new staggering of the increase of the retirement age for magistrates, by adding an additional period of 1 year and 6 months, until 2036.
Magistrates will be able to retire in advance, provided they are 35 years old, but if they are not 65 years old, an annual penalty “2% until the standard retirement age in the public system” will be applied.
The project has generated harsh reactions in the judicial system and led to the triggering of protest actions at the level of courts and prosecutor's offices throughout the country.
