The Ministry of Finance published on Thursday evening, in public debate, the draft law revised with the new taxes that will enter the package 2 of fiscal measures. Among them, the project also provides for psychological and integrity tests for ANAF employees and those of the National Gambling Office (ONJN), as well as the use of bodycam cameras at tax and customs controls.
The project proposes “to introduce the possibility of integrity testing, including for the detection of the concealed behavior, in case there are data and indications regarding deviations from the integrity of the personnel who hold the public management positions in ANAF, respectively of the personnel who hold general execution functions within the fiscal inspection and forced execution, at the request of the management”.
Thus, in order to maintain the public management positions within the ANAF structures “it becomes imperative to hold/obtain the psychological opinion and the psychological opinion of integrity, issued by specialized units authorized by the College of Psychologists in Romania, annually or at the request of the Agency, as part of the requirements for exercising the public function for these categories”.
According to him, by implementing the measure of requesting the psychological opinion of integrity, a system of prevention, identification and monitoring of deviations from the integrity rules is implemented.
The project also provides for the introduction of obligations for the officials of the National Gambling Office (ONJN).
Candidates for competitions for the occupation of public functions in ONJN will have the obligation to present two opinions: one regarding the complex psychological evaluation and another regarding the level of integrity.
Periodic psychological testing will be introduced, every 2 years, for all civil servants within the institution. The project also provides for the possibility of carrying out additional assessments in justified situations, following the improper behavior at the workplace.
Legal framework for Bodycam registration at tax and customs controls
The legal framework for the immediate use of already existing photo-audio-audio-audio-audio-audio-aircraft fixing will be created within the customs control missions. The technical resources in the endowment will be operationalized.
Thus, the use of bodycam by the anti -fraud inspectors and the customs staff in the control operations will be allowed. In this sense, Law 86/2006 on the Customs Code of Romania will be completed.
“The proposed measure will lead both to the prevention of committing illegal facts, in particular corruption and to reduce the activities and behaviors that violate the rules of conduct of the customs staff, as a result of the awareness that the interventions and actions of the customs workers are registered and fixed the photo-video,” the note is found.
The project also provides for the implementation of portable body-video audio-video recorders (bodycam-rooms worn on the body) for ANAF inspectors within the tax directions.
On Thursday evening, the Ministry of Finance launched in public debate the revised draft law with the new taxes that will enter the package. Minimum gross salaries in the country for income from independent activities, as well as many other changes for companies and individuals.
This draft law is one of the six normative acts in the package 2 measures for which the Ilie Bolojan government will take responsibility in Parliament next week. All six projects are to be adopted on Friday, August 29, by the Government.
