Mrs. Dorota lived without a father for years. Now he has to pay maintenance for him


Mrs. Dorota last saw her biological father when she was four years old. Her accounts show that he was abusing alcohol and applied violence against his family. Her mother divorced him in 1998. The daughter forgot about her father, who never looked for contact with her.
In 2023, she got a letter from the Municipal Social Welfare Center in Wilkowice with information that he was to pay for her father's stay in the DPS. The man has been in it since 2019.

– When I saw the magazine, I felt hatred because it is a terrible injustice. I felt sorry for him. Later, great rage came to the commune head. Because I think: damn, how? What a miracle? On what basis? – Dorota complains in the “Intervention” program.

Mrs. Dorota does not want to pay alimony for her father. He doesn't even remember him
She appealed against this decision, but without results. For a monthly stay of her father in DPS, she should pay just over 5,000. zloty. What's more, the facility counted her debt at 55,000. zloty. So Mrs. Dorota is still fighting for exemption from all these fees.
Lawyer Bartosz Graś explains in the “Intervention” program that all the maintenance obligation is on all.
– And it is towards our children, but also to our parents, grandparents. This maintenance obligation is subject to certain exclusion. If in this case the father behaved unworthy of his family, then we have the basis for claiming that we would not bear the cost of keeping the Father in the DPS-he explained.

According to the lawyer Mrs. Dorota has the full right not to have to pay for her father's stay in the DPS. First of all, because her father abused her family. In addition, he did not contact her.
Pursuant to Polish law, adult children may be obliged to pay maintenance for their parents. This principle results from the Family and Guardianship Code (Articles 128-133). However, maintenance on the parent is not applied automatically. It is the court that decides about it, analyzing the material situation of both parties, the family and the relationship between individuals. Alimony is applied to children when the parent is inactive. It is important, however, that the person who supports him financially has sufficient funds for this.
