The Border Guard will be able to impose fines for photographing SG infrastructure, including border crossings – according to the draft regulation of the Ministry of Interior and Administration. The formation will also be able to impose a fine of up to 10,000. PLN for violating the provisions regarding the employment of foreigners.

It is a draft amendment to the Regulation of the Ministry of Interior and Administration on offenses for which Border Guard officers are entitled to impose fines through a penalty mandate. The project was prepared in connection with the entry into force of the Ministry of National Defense Regulation on the prohibition of photographing critical infrastructure without permission.

Sanctions for violating the ban on photographing objects particularly important for the security or defense of the state were included in the Act on the defense of the homeland. According to this regulation, a person who photographs, film or otherwise consolidates the objects or persons in them in this regulation is punishable by arrest or a fine. However, these objects must be marked with a sign of photography.

Currently, this does not fit into the catalog of offenses indicated in the Regulation of the Ministry of Interior and Administration on offenses for which SG officers are entitled to impose seats. According to the planned amendment, a new offense will be added, which will apply to the Border Guard infrastructure, border crossings or other infrastructure facilities, referred to in the SG Act, i.e. places where formation officers perform their statutory tasks.

“The introduction of the above regulations will enable the Border Guard officers efficient and effective response to the disclosed offense and taking effective actions, without having to engage other authorized services” – we read in the justification to the planned regulation.

The draft also takes into account the provisions introduced by the Act on the conditions of admissibility of entrusting work to foreigners in the territory of the Republic of Poland. It is a penalty for violations of regulations regarding the employment of foreigners, for which the Border Guard will be able to impose a fine in mandate proceedings of up to 10,000. zloty.

The regulation is to enter into force on the day after the day of publication. (PAP)
