“The first and important is that the head of the CAP Alexander Klimenko today can report suspicion to officials of category A, people's deputies, ministers, that is, all top officials. This is what was liquidated in the previous bill on the destruction of independence, which transferred these powers to the Prosecutor General,” he said.
In addition, according to Krivonos, now the head of the SAP can independently create a group of prosecutors in criminal proceedings. This is important, because usually in particularly sensitive matters, he appoints the prosecutor only himself to reduce the risks of information leakage, writes Suprilna.
The new law also deprives the Prosecutor General of the right to demand any case with NABU in order to transfer it to another law enforcement agency, as stated in the law adopted before that. At the same time, Krivonos emphasized that while he was acting, Prosecutor General Ruslan Kravchenko did not use these powers.
“He did not demand the case, he did not study them, he did not determine the investigation of our affairs for other law enforcement agencies, that is, no intervention in this part happened,” Krivonos said.
Inspections of NABU employees and other law enforcement agencies on the polygraph stipulated by Law No. 4560-iX, the director of the anti-corruption bureau called normal practice. There should be two such checks. The first – once every two years, the NABU internal control unit should conduct. The second – for six months should be carried out by the SBU (without a compulsory polygraph).
“This is a normal practice for us. Our unit of internal control is conducting a lot of printing research. The only problem that we need to solve is now to get additional polygraphologists to the state,” he said.
Context
On July 22, the Rada adopted bill No. 12414, which provides for the expansion of the powers of the Prosecutor General, in particular, regarding criminal proceedings engaged in NABU and SAP. The law on the same day signed Zelensky, the next day – the document entered into force.
Anti -corruption bodies warned that the law gives the Prosecutor General of Ukraine access to all NABU cases, he will have the right to give instructions to detectives, and will be able to close the investigation at the request of the defense. In the CAP and NABU, they said that at the last moment the bill at the last moment made edits, which “actually destroy the independence” of the SAP and NABU.
After a wide resonance, mass protests against the law and calls of the European Union, US senators and a number of international organizations to cancel these changes, the president introduced the corresponding bill to the Rada.
July 31 Verkhovna Rada adopted a bill on the restoration of the independence of anti -corruption bodies. 331 People's Deputy voted for the bill – no one abstained and voted against. On the same day, the law was signed by Zelensky.
