Waldemar Żurek releases judges. Is the reaction of Adam Bodnar


Bodnar's statement took place shortly after the announcement of changes in the management of the Ministry of Justice, as a result of which it was sour Żurek who replaced him as the head of the ministry and the prosecutor general.

During his first press conference, Waldemar Żurek announced wide staff changes, including Call of nine judges delegated to work in the ministry and suspension of 46 presidents and vice presidents of courts related to the so -called “Neoks” or appointed with her participation. Among the suspended was, among others Małgorzata Hencel-Święczkowska, privately wife of the current president of the Constitutional Tribunal. Żurek noted that the decision was not a personal or repressive nature.
Adam Bodnar, when asked by journalists about the legitimacy of the suspension of Hencel-Święczkowska, stated that if there were substantive foundations for this, such a decision is justified.
He noted, however, that The actions of the Żurek are only the first stage, and the cancellation procedure itself requires a positive opinion of the Court's College.

The former minister also reminded that During his term of office, 120 presidential presidents and vice presidents were replaced, but it was not always possible to carry out the full procedure – In some cases, court college did not agree to appeal.
Żurek also announced the withdrawal of the so -called the law of law, which was to regulate the status of judges established after 2018 with the participation of the current National Court Register – an institution assessed by the new authorities as politically politicized and unconstitutional.
Bodnar expressed doubt about the effectiveness of this move. As he noted, the opinion of the Venice Commission was ordered by the Parliamentary Assembly of the Council of Europe, and not directly by the Polish government. Therefore, in his opinion, the withdrawal of the project by MS does not necessarily mean that the opinion will not arise. He also pointed out that the lack of cooperation from the Polish government may hinder the Venetian committee's assessment of new bills.

At the end, Bodnar assured that he had no regrets for Prime Minister Donald Tusk because of his reference from the government. As advice for his successor, he indicated the need to cooperate with prosecutors based on mutual trust and respect for their professionalism. – Only then will there be a chance for effective continuing to investigate and explain subsequent matters – he noted.
