The City Hall of Krasnoyarsk illegally sold a plot for 28 million on Malinovsky by 7 times cheaper

The prosecutor's office revealed the illegal alienation of land worth 28 million rubles on Malinovsky Street in Krasnoyarsk.

It was established that in 2017, the administration of Krasnoyarsk sold LLC Promeko a plot of 13.9 thousand square meters. m. For 4.2 million rubles – 7 times lower than the cadastral value.

“The basis for such a generous discount was the presence of a capital construction object on the site – supposedly multi -level parking. But she was not there. Instead of it, there was a temporary design on the site – several reinforced concrete pillars with a wooden flooring, resembling an overpass of 13i16 meters in size. According to the law, such a building could not be considered a capital object and, therefore, did not give the right to redeem the land without bidding, – the prosecutor’s office explains. – However, the transaction took place and almost immediately after registration of the “parking” was dismantled. The site, received very inexpensive, turned out to be free. Moreover, before the prosecutor’s audit on this land, it was planned to build apartment buildings, despite an acute shortage in the area of kindergartens and schools. ”

The damage caused to the municipality amounted to about 24 million rubles.

Based on the materials of the prosecutor's office, a criminal case on fraud on an especially large scale was opened (Part 4 of Article 159 of the Criminal Code of the Russian Federation) and a lawsuit was prepared for the demand for land from someone else's illegal possession and its return to municipal property.
