The President of the Superior Council of Magistracy (CSM), Elena Costache, says she does not realize “what is desired”, in the context in which the Government announced a reform of the pensions of the magistrates, and President Nicușor Dan accused a “debt” in the procedure by which the magistrates enter the pension. “And then you only think about the fact that they will destabilize, a justice that is no longer independent, a serviced justice,” says the head of the SCM.
Elena Costache says, in an interview for TVR, that she speaks on behalf of the magistrates, who are “shocked, shocked” by the statements of Nicușor Dan, who accused the “Debardada” of the SCM: “In our opinion, he has only tried to cover his own fault in the failure of the retirement decrees.”
“The reference to the Debanda has linked it to the fact that in the retirement applications is not specified the date from which the retirement is required (…) we do not have to pass our colleagues, because in this procedure they do not know when the president signs the decrees and when the decrees leave for the Official Gazette,” TVR.

Although he explained that the magistrates “do not have” the retirement date in requests, Elena Costache still admits that some magistrates do it.
“It surprised me that this reference was targeted by all the decrees he had on the table, given that there are colleagues who have passed the date. Maybe he did not notice this, he spoke globally, in the general way. Distinction ”, accuses the head of the SCM.

Costache says that there is no “legal provision” that forces the magistrates to request the release at a certain date “from the mentioned considerations”: “You have no place to know, there is no predictability related to a term in which you know that on the day you will be signed.”
The head of the SCM also spoke about the 90-day term that the magistrates have to announce their intention to retire, a provision invoked by Nicușor Dan. Costache said that the “purpose” of this term is to allow the courts and prosecutor's offices to organize themselves, and the magistrate who retires to finish his files.
“However, it is not the attribute of the president. It exceeds the duties of God. He does not have the legal authority to verify our decisions,” said CSM chief.
“I do not realize what is desired. And when you do not realize, when you do not understand some things, you do not see the purpose, the clear purpose, although they are prevalent, see Lord, of budgetary measures, of … we do not understand! And then you only think about the fact that they will destabilize, a justice that is not independent. To be such a justice, ”said the head of the SCM.
“The president is not a notary,” said Nicușor Dan to the Superior Council of Magistracy, on Wednesday, in a press conference on the special pensions of the magistrates. He criticized that there is no predictability regarding the retirements and that the magistrates who want to retire do not mention in their requests the date from which they want to leave the system.
“From the retirement applications it results in a question to the SCM: What is this debt? 70% of the requests does not indicate a precise date of pensions. It must be provided clearly once retirement. In these 70% of cases it is not indicated or indicated,” said the president.

The retirement age will increase to 65 years for magistrates, and the seniority will increase, from 25 to 35, from which they can retire, prime minister Ilie Bolojan announced on Tuesday, in a press conference. The pension of the magistrates will be a maximum of 70% of the last net salary, compared to 80% of the gross salary, as it is now, said Bolojan.
