Helsinki Foundation for Human Rights with an appeal to the prime minister for the reaction of “defenders of borders”

The Helsinki Foundation for Human Rights has expressed an objection to the actions taken on the Polish-German border by self-proclaimed groups referring to “borders' defenders. At the same time, she appealed to the prime minister and the head of the Ministry of Justice for immediate response and shortening such initiatives.

On some sections of the Polish-German border, people associated with the so-called By the borders' defense movement, appointed by the national communities activist Robert Bąkiewicz. Members of this movement declare that “they are guarding the border with people trying to cross it illegally.”
HELSIŃSKI Foundation for Human Rights (HFPC) in a position on the situation at the Polish-German border expressed categorical opposition to actions taken by “Self -proclaimed groups referred to as +borders' defenders, which usurp the right to stop and control entering into the territory of the Republic of Poland vehicles under the guise of + disclosure + migrants transported in them. “
“Members of such groups in an unauthorized way They attribute the competences of state bodiesbelonging only to the police and the Border Guard, forces people traveling by vehicles to specific behaviors, which in itself violates public order, and in extreme cases, if threats or violence are used, it can fulfill the features of the crime described in art. 191 parish 1 of the Penal Code (forced a person to behave a specific behavior), “HFPC said.
Referring to media reports, she added that there was a risk that the actions of the so -called Borders defenders can also exhaust the features of the so -called hate crimes.
“The threat to the public order, which is associated with the activities of the groups described above, should be encouraged by the public authorities to immediately respond and curl these types of initiatives to agree to the rights, freedom and security of third parties, both traveling from Germany to Poland to Poland and migrants, who, even in the case of unlawful entry or stay on the territory of the Republic of Poland state.
In her opinion, although the action of “defenders of the border” has their inspirators trying to break political capital on it, “probably some people declaring themselves as such defenders actually act in the belief that migrating persons are by definition a threat to state security.” “This belief is mainly due to the current political narrative regarding migration and deliberate fueling of social fear of migrants. Unfortunately, this type of narrative is also used by the current Polish government,” she assessed.
“Projects implemented by this government in the field of migration issues, starting from the ordinances extending the prohibition of being in the border zone at the border with Belarus, through the migration strategy, to the draft law introducing the Act to the Polish legal order, the mechanism of suspending the right of foreigners to apply for international protection, they were justified in a low -objective manipulation of the manipulation” – assessed the foundation.
She pointed out that as a result of government narrative and solutions introduced in society, fears of migration and lack of trust in the state dominate, and these moods mobilize politicians of various options for radicalized initiatives. That is why the Foundation “Perpetual calls for an honest and reliable discussion with the Polish society about the phenomenon of migration and the real and multi-dimensional situation on the Polish-Belarusian border.”
On Tuesday, Prime Minister Donald Tusk announced that he had decided to restore control at the border with Germany and Lithuania. He explained that this is necessary to minimize uncontrolled migrants. The head of government also criticized the political use of the situation on the border, calling such behavior “shameful and scandalous”.
As he emphasized, a politician who uses politically militants or activists, “puts himself as someone who bothers the Polish state to care for the safety of citizens, border and our territory,” said the prime minister.
In turn, President Andrzej Duda said on Thursday that he was amazed at the violent reactions of Prime Minister Donald Tusk to civic patrols formed on the Polish-German border. As he said, they are made up of people who help the Border Guard to carry out its task.
