“Pseudomedics should answer penalties.” The Supreme Medical Council believes that the government reform is too weak

Pseudomedical internships would realistically shorten the introduction of criminal liability of people who take part in their performance – believes the General Medical Council.


In the Friday position, NRL supported the direction of changes in the draft amendment to the Ministry of Health on Patient Rights and the Patient Ombudsman and the Act on the Emergency Notification System.
The MZ project defines pseudomedical practices and prohibits their performance as highly harmful to health. The project extends the rights of the Patient Ombudsman who will be able to consider the practice of pseudo -domedic, order its omission and impose a financial penalty for such activities.
NRL's reservations relate to the fact that The project is only provided for in the administrative and legal model of combating pseudomedical practices. In the opinion of the local government, the only means that can realistically curtail these practices would be to introduce criminal liability of people who take part in their performance. As NRL emphasizes, especially when such practice is aimed at or lead to the fact that the patient resigns from treatment in accordance with current medical knowledge or does not take treatment.
The local government noted that in the case of criminal liability it would have permanently burdened on the person who provided such services. The position indicates that in the case of administrative proceedings conducted by the MPC, the commercial law entity will be able to liquidate the activity, and in its place a formally new entity will be created that will continue its activity.
The health department provided for consultation in June assumes that pseudomedical practices will be prohibited as a highly harmful activity for health, and the Patient Ombudsman will be able to impose up to PLN 1 million in proceedings in these cases.
Pseudomedical practices will be separated from practices violating the collective rights of patients. This would be, among others providing benefits by a person who does not perform a medical profession, offering or using methods that are assigned the properties of health services, leading to deterioration of health, failure to not be abandoned or withdrawing from treatment or diagnostics. Medical disinformation would also be pseudo -medical practice if it had to achieve property and personal benefits from it. (PAP)
