Austrite Law: Romanians will receive only 55% of the salary in medical leaves up to 7 days

Romanians with diagnosis of ordinary disease (such as viruses, infectious diseases, digestive disorders, etc.) who receive a certificate of medical leave with a duration of up to 7 days will receive only 55% of the salary, compared to 75%, as it is now. The measure appears in the draft law that includes the austerity measures decided by the Bolojan Government, a document published by the Ministry of Finance.

The ordinance of austerity proposes differentiated percentages for the payment of medical leave, depending on the total medical leave granted for each episode of the disease.

People who receive medical leave for temporary incapacity between 8 and 14 days will receive 65% of the salary.

The 75% allowance of the salary remains valid in the case of persons who receive from 15 days of medical leave.

The match of the austerity ordinance, the monthly gross amount of the temporary incapacity for work caused by ordinary diseases are determined in relation to each episode of the disease, as follows:

  • a) By applying the percentage of 55% on the calculation base established according to art. 10 for medical leave certificates issued for a period of up to 7 days of temporary incapacity;
  • b) by applying the percentage of 65% on the calculation base established according to art. 10 for medical leave certificates issued for a period between 8 and 14 days of temporary incapacity;
  • c) by applying the percentage of 75% on the calculation base established according to art. 10 for medical leave certificates issued for a period of over 15 days of temporary incapacity for work.

The ordinance also stipulates that Romanians suffering from cardiovascular diseases will receive allowance for medical leave worth 75% of the salary, as before.

The maximum duration of the medical leave is 183 days within one year. For certain serious conditions, the period can be extended up to 12 months.
