More time after divorce to change the name. The Senate supported the new recipes

On Wednesday, the Senate adopted an amendment to the Family and Guardianship Code extending from three months to a year time to submit a declaration of return to the name from before the wedding. The deadline applies to the becoming of a divorce decision.


88 senators voted in favor of accepting the amendment, no one was against or abstained. Now the amendment will go to the president's signature.
The amendment to the Family and Guardianship Code, prepared by the Ministry of Justice, was one of the projects under the deregulation package. The regulations assume an extension from three months to the year of the period in which the divorced spouse may submit a statement of returning to the name he had before the wedding. The deadline runs from the divorce decision becomes final, and the statement shall be made before the head of the Registry Office or consul.
Previously combined committees of justice and human rights and legislative recommended the adoption of the amendment without corrections.
Senator rapporteur Krzysztof Kwiatkowski emphasized that the current provisions provide for the possibility for a divorced spouse to submit a statement of returning to the name he had before marriage, but too short a deadline is a burdensome problem for some.
“This statement must be submitted in person before the head of the Registry Office or the consul within three months of the divorce decision becomes final. After this deadline, the change of name may take place, but in a more time -consuming and more difficult procedure, because in the procedure only the provisions of the Act amending the name and surname,” he noted.
The senator added, citing the justification attached to the amendment that the solutions contained in it are in line with social needs. He noted that the Association of Civil Registry Officials of the Republic of Poland requested extending the deadline to submit a statement from three months to a year, because the USC employees indicated that people wanting to return to their name from before marriage were often not aware of their deadlines.
“In the draft amendment, we also have transitional provisions, which provide that if the deadline for the spouse to submit a divorced statement of returning to the surname he had before marriage did not pass before the date of entry into force of the opinion, it will be extended to a year, i.e. that they will be able to use this provision,” he emphasized.
The amendment will enter into force three months after its announcement.
