The prosecutor's office accuses the politicians that they did not comply with the final judgment of the Court to ban public functions and at the end of December 2023 they carried out mandates of MPs.

At the beginning of April, the European Parliament lifted the Wąsik and Kamiński immunity. Prok. Skiba – spokesman for the case of the District Prosecutor's Office in Warsaw – said on Monday PAP that the deadline for which both politicians were called was set for June 24.

On December 20, 2023, the District Court in Warsaw convicted Mariusz Kamiński and Maciej Wąsik, as former heads of the CBA, legally for two years imprisonment for exceeding the rights in the so -called The 2007 land scandal has also ruled a five -year ban on public functions against them. Both Kamiński and Wąsik were pardoned by President Andrzej Duda.

Sejm Marshal Szymon Hołownia issued a decision on the expiry of the seats of both PiS deputies in connection with their final conviction. Both politicians lodged appeals against the decision of the Speaker of the Sejm, which Hołownia sent to the Chamber of Labor and Social Insurance of the Supreme Court.

In connection with the dispute within the Supreme Court, the case of Kamiński was considered by the SN Labor and Social Insurance Association, which did not take into account his dismissal. The Marshal of the Sejm published a decision to expose his mandate and the mandate after Kamiński was taken by Monika Pawłowska in March 2024.

In turn, the judge appointed to the case of the appeal of a mustache in the work chamber issued a decision to transfer it to the Chamber of Extraordinary Control and Public Affairs of the Supreme Court, which annulled the Marshal's decision to expire the mandate of Wąsik. Marshal Hołownia refrained from the publication of the decision in this matter. The mandate after him remained unwashed.

A day later, the Chamber set aside the decision to expire Kamiński. This was possible, because both politicians, regardless of their appeals lodged to the work chamber through the marshal, sent appeals directly to the Chamber of Extraordinary Control.

Kamiński and Wąsik took part in the EP elections, which took place on June 9, 2024 and won MEP fines. Therefore, at the end of June 2024, Wioletta Kulpa took the parliamentary mandate after a mustache.

In July 2024, PG sent applications to repeal the immunity of Wąsik and Kamiński. The prosecutor's office announced that “the evidence gathered in the case provided grounds for establishing” that Kamiński and Wąsik, despite the final ban on public functions against them, did not follow him and performed mandates of deputies by taking part in the deliberations of the Sejm on December 21, 2023, including in voting number 141-147 and through the participation of December 28, 2023 in meeting of the Sejm Administration and Internal Affairs Committee. “

It was reminded at the time that on April 18, 2024, these findings allowed Kamiński and Wąsik to present the allegations of committing crimes from the article of the Penal Code speaking for sanctions for not complying with the court imposed by the court, among others taking a position in state institutions.

However, as in the summer of last year, the National Prosecutor's Office indicated when the request to repeal the immunity of both MEPs went to the EP, “at the current stage of the proceedings, it is necessary to supplement the mourn of the charges presented to them, and then referring the region of the accused to court.”

Both politicians referred to the case after the immunity in the EP was repealed. Kamiński assessed, among others, that the accused of them “show in a bright way how extremely politicized” the prosecutor's office managed by Adam Bodnar is; Wąsik, however, stated that “there is no more political conclusion” than “prosecution of deputies for performing his duties.”
