One of the most critical prosecutors in Romania, sanctioned by the SCM with the diminution of the salary / is the prosecutor in Europe with the most disciplinary actions

The Section for Prosecutors in Disciplinary Matter of the Superior Council of Magistracy (CSM) decided on Wednesday to sanction the first prosecutor of the Prosecutor's Office of the Bucharest Military Court, Bogdan Pîrlog, by reducing the salary for three months by 10%. President of the Association Initiative for Justice, Bogdan Pîrlog was disciplined by the Judicial Inspection on several occasions for his public opinions.

The decision to sanction the prosecutor Bogdan Pîrlog was not unanimously taken. Three of the prosecutors of the section voted for sanctioning, and the other two for rejecting the action.

“By the majority, it admits the disciplinary action formulated by the Judicial Inspection against the defendant prosecutor Bogdan Ciprian, the first military prosecutor of the Military Prosecutor's Office attached to the Bucharest Military Court, investigated in the aspect of committing the disciplinary deviation provided by art.271 lit.f) of the Law no.

On the basis of art.273 para. (1) letter. b) of the Law no.303/2022 on the Statute of judges and prosecutors, applies to Mr. Pîrlog Bogdan Ciprian, the first prosecutor of the Military Prosecutor's Office attached to the Bucharest Military Court, the disciplinary sanction consisting in the diminution of the monthly gross employment by 10% for a period of 3 months, for the commission of the discipline provided for art. 271 letter. f) of Law no. 303/2022 regarding the statute of judges and prosecutors ”, it is shown in the decision published on Wednesday by the SCM. Art. 271 provides, in letter f): the non -observance by the prosecutor of the provisions of the higher hierarchical prosecutor, given in writing and in accordance with the law.

The sanction decision is not final, and can be challenged in court.

What Bogdan Pîrlog says

The prosecutor is accused of not complying with two orders issued in 2023 by the Military Prosecutor of the Military Prosecutor's Office attached to the Military Court of Appeal, a higher hierarchical prosecutor.

“It is about an order with nine points that were besides the total law, it had no job, and it was prohibited including access to weapons in the constituency of the Court of Appeal that is the territory of Romania. That order was inapplicable, but the problem is that no one checked if any of the nine points was violated. Because, two weeks ago, they sanctioned my deputy, again for an aberration, “prosecutor Bogdan Pîrlog told Hotnews.

He announced that he will challenge the CSM decision in court.

“I do not see how these decisions could remain final. The idea is that they are desperate to decaize the military parquet. As we can see, we are working, we are unpredictable,” said Pîrlog.

Record of disciplinary sanctions

The head of the Bucharest Military Prosecutor's Office has been disciplined several times by the Judicial Inspection and sanctioned by the SCM for public statements considered to undergo the prestige of justice. The sanctions were subsequently canceled by the High Court of Cassation and Justice.

Despite the disciplinary investigations triggered against him, the prosecutor continued to criticize the “disaster” in the judicial system. Last week, the Professional Association of Prosecutors led by Bogdan Pîrlog asked President Nicușor Dan to prioritize the justice reform, especially in the field of corruption.

On the occasion of that approach, the prosecutor has brought new critics to the Judicial Inspection, accusing that it is a “tool of repression against the uncomfortable magistrates”.

Bogdan Pîrlog is the prosecutor who opened the file against the gendarmes for the violence of the rally on August 10, 2018, being the one who was self -identified in the case of violent intervention of law enforcement against protesters in Victoriei Square.
