Changes are coming for owners of old type photovoltaic panels. The climate ministry plans to change the regulations regarding used electrical and electronic equipment, where one more important provisions will be the one regarding the utilization of used panels. The new regulations are mainly aimed at Improving the recycling process of panels, which more and more goes to Poland from abroad, especially from Germany.
As earlier reports indicate, the used import solar from import becomes a serious environmental problem. The planned date of adopting the novella by the government is the second or third quarter of this year.

The draft act amending the Act on useful electrical and electronic equipment published by the Chancellery of the Prime Minister at the end of May is aimed at adapting the Polish right to EU regulations regarding waste management and improving the efficiency of the system of collecting and processing used electrical and electronic equipment (ZSEE).

It is also to increase the responsibility of producers. The project provides for the introduction of new obligations for manufacturers of electrical and electronic equipment, such as the obligation to finance the collection and processing of waste and to ensure adequate infrastructure to collect them.

The bill focuses on issues related to recycling and responsibility of panel manufacturers for waste management created after the end of their operation.

It is about panels from before 2015 …

In short: according to the proposal of the climate ministry, the obligation to finance the utilization of panels that went to the market between August 13, 2005 and the end of 2015, will fall on the installation users. Importantly, it is about installations not intended for home purposes. This means that the owners of such installations will be required to cover the costs of their development after use.

As explained in the assumptions for the project, in accordance with applicable regulations, the division of obligations between the introductory equipment and owner of used equipment depends on this, Whether it was marketed until August 13, 2005 (so -called “former equipment”) or later.

At the same time, the regulations oblige to introduce electrical and electronic equipment to achieve minimal annual levels of collection, followed by recovery and preparation for re -use and recycling of such equipment.

The planned novella is to introduce the EU Directive 2024/884 from 2024 to Polish provisions, according to which the “former equipment” will be considered in the Act on useful electrical and electronic equipment, equipment intended for households introduced on the market before 13 August 2005,, Photovoltaic panels for households placed on the market before January 1, 2016. and the equipment underestimated in the Act, the placed on the market before January 1, 2018.

The following equipment includes:
large -scale and small -scale household appliances, IT and telecommunications equipment, consumer equipment and photovoltaic panels, lighting equipment, electrical and electronic tools except large -scale stationary industrial tools, toys, recreational and sports equipment, medical devices except for all impaired and infected products. Subjecting vending machines.

The list states that, in accordance with the proposed regulations, users of not intended for households will be covered by the obligation to finance the development of the solar panels they use, which were marketed between August 13, 2005 and December 31, 2015 and the equipment not mentioned in the Act, which was placed on the market between August 13, 2005 and December 31, 2017. equipment.

In addition, the amendment aims to include in the laws of packaging and packaging waste in laws, as well as the recycling of withdrawal vehicles from the operation of one of the provisions of the EU Directive 2018/851 of 2018, i.e. the introduction of an authorized representative of an authorized representative. This institution is to be modeled on the provisions of the Act on useful electronic electrical equipment. The amendment to set out the rules for its determination and a list of entities that can function in this nature.

The list states that currently entrepreneurs who are based outside Poland are not able to establish an entity responsible for performing duties related to packaging management or recycling of vehicles that they bring to the market. After the amendment to the provisions, in the event of the establishment of an authorized representative, his principal will only act through this entity, and the authorized representative will be responsible for performing his statutory duties. Due to these changes, the amendment also adapts the relevant provisions of the Waste Act.

The bill is currently in the public consultation phase, which allows you to submit comments and proposals of changes by the parties. After completing the consultation, the document will be forwarded for further procedure in parliament.
