In 2002, he received a 3-month sentence, in 2003, a sentence of 6 months in prison, and in 2004 another sentence of 6 months, after the third conviction being incarcerated for 5 months.
“From the mentions made in the register of criminal executions for 2004, it turns out that the petitioner began the execution of the sentence on 24.05.2004, being released on condition on 07.10.2004”, the Onești Court Decision, by which, on February 6, 2012, the request for rehabilitation was admitted.
According to the legal provisions in force at that time, the convicted person could request the rehabilitation if in the 4 -year interval to which half of the pronounced sentence was added, he did not receive a new conviction, had the existence through work and paid the civil damages and the judicial expenses.
In this case, the man paid the costs, not the civil damages to which he was obliged. The Onești Court established that “their non -payment, as it results from the witness's statement, did not due to the fault of the petitioner, who submitted diligence for payment”. Thus, the court established that the man fulfills the conditions of rehabilitation, the request being admitted, and the three convictions were deleted from the record.
In addition to the convictions received in Romania, the author of the crime in Cosmopolis was also convicted in Italy. It is the only conviction that appears in the record.
