What the Constitutional Court has decided

Also on Thursday, May 29, the Constitutional Court of Romania decided that the statements of wealth and interests will no longer be published on the website of the National Integrity Agency (ANI), and these statements no longer have to include the revenues and goods of the spouses.

Basically, by this decision, which is final and mandatory, the statements of wealth and interests will be kept secret.

According to the RCC, statements of wealth and interests will no longer be published on the websites of other public institutions, where those who have to declare their assets, because the “right to the protection of privacy” are violated.

The decision of the constitutional judges will produce effects for the future and does not concern the statements of wealth and interests filed before the publication of the decision in the Official Gazette of Romania.

Three days ago, Dragoș Anastasiu was invited to Primanews. There, he made a broad statement, which profit cited after the CCR decision. “Let's get rid of this stupidity with the declaration of wealth put in public. Does no one tell you not to have a statement of wealth submitted to a state institution. Dom'le, but what interests you how many jewelry do I have in the house? What are you interested?”

He motivated his opinion, based on the idea that transparency in wealth statements are why valuable people do not enter politics.

“And I know a lot of people who say, dom'le, I would go (in the public sector-no), but to make a statement of wealth … and not to do, I put it public … I do not go! So yes-a statement of wealth, yes-filed as a service secret …”, said the counselor of Nicușor Dan. Anastasiu is not paid.

According to the description on the website of the Presidential Administration, Dragoș Anastasiu is an honorary counselor of the President of Romania for the relationship with the business environment, within the Department of Economic and Social Policy.

In contrast, the President of Romania said on Thursday, after the RCC decision, that “the surprising decision of the Constitutional Court announced today is in contradiction with an essential principle of democracy – transparency in the exercise of public functions,” Nicușor Dan wrote. The reaction came quickly, in a message published on the president's Facebook page.

“The access of citizens to information on the statements of wealth of dignitaries is a guarantee of integrity and responsibility in the public space, and this principle must be defended firmly,” said the head of state.

“If the motivation of the decision identifies the technical deficiencies within the current legislative framework, it is the responsibility of the Parliament to correct them with speed,” concluded Nicușor Dan.
