In February, the Supreme Court decided that the work performed by the teacher above the norm of time specified in the teacher's card was overtime within the meaning of the Labor Code. This shed new light on the issue of accounting for teachers' working time and their reward. However, the Ministry of National Education made its activities dependent on the written justification of the Supreme Court resolution.

On Wednesday, during the press conference of Minister Nowacka, she reported that the case would be dealt with by a team of professional pragmatics, whose meeting she convened.

As she said, the team is to develop a model that “will allow us to pay teachers and teachers in a worthy, proper and very careful way for the working hours they do.”

“This is probably one of the biggest challenges for many years (…). Therefore, it cannot take place without talks with trade unionists, without talks with local governments that schools maintain, but also with labor law specialists,” she added.

The team's meeting is to take place at the beginning of June. Representatives of the National Labor Inspectorate and the Ministry of Finance are also to take part in the talks.

The legal dispute, which found its finale in the Supreme Court, resulted from the fact that the regulations relating to the time of teachers' work are in the teacher's card, and according to it the teacher may be obliged to work for a paid work at “oversized hours” that are associated with the teacher's salary. However, the teacher's card does not regulate the issue of “overtime” – going beyond the weekly working time standard and in some cases of non -teaching or educational classes.

The teacher who brought the case the basis of a legal question, as an English high school, she was the coordinator of the students' foreign exchange project. In her situation – as she pointed out in the lawsuit – additional work included, among others Preparation of students for traveling and organizing a trip to the host country and return, taking part in the training for schools participating in the program, performing the function of a connector between the sending school and the receiving and regular communication with teachers from the host school.

The courts of both instances in part took into account her lawsuit and granted her over 18.5 thousand. PLN remuneration for overtime work with interest. In this context, it is also indicated that teachers develop overtime beyond the standard of 40 hours a week, not only by implementing educational projects, but also, for example, when organizing and then on trips to school trips, or on the so -called Green schools.
