The government will deal with two deregulatory MC projects

The Council of Ministers on Tuesday will deal with two projects by the Ministry of Digitization (MC): amendment to the Act on computerization, which provides for facilitating access to state registers and a resolution on the appointment of a digital service coordinator, which is required by EU provisions.


According to the prime minister published on Friday, the order will show that the government will deal on Tuesday with an amendment to the Act on the operation of entities carrying out public tasks (in short, the Act on computerization – PAP) and the resolution of the Council of Ministers regarding the designation of the coordinator for digital services. Both projects – according to the entry – are the result of work on the deregulation of the economy.
The draft amendment to the Act on computerization assumes facilitating access to state registers for companies. In justified cases, an administrative decision will not be required – according to the assumptions of the project, published in the second half of April on the website of the Chancellery of the Prime Minister. The Minister of Digitization will issue an administrative decision only if you refuse to provide the data register and withdraw the sharing. A positive answer will mean the possibility of access – explained in the assumptions.
The proposed regulations provide that private companies are also to gain access to photos from the register of ID cards to verify the identity of contractors, and banks – access to the database of newly issued ID cards. The purpose of introducing these changes is to increase the effectiveness and safety of processes to determine the identity of natural persons – it was pointed out.
The draft resolution of the Council of Ministers regarding the designation of a coordinator for digital services is related to the implementation of a digital service (DSA). Pursuant to EU regulations, the coordinator is to supervise the use of DSA. Member States had time to designate it until February 17, 2024. Until now, Poland, the Czech Republic, Cyprus, Spain and Portugal did not do it. On Wednesday, the European Commission announced a complaint to the CJEU to these countries in connection with the failure of the coordinator.
At the beginning of April this year. Deputy Minister of Digitization Dariusz Standerski informed that the ministry wants the President of UKE to be the CEO and the President of UOKiK to supervise the protection of competition and consumers in the field of DSA.
The act on digital services (DSA) is the world's first digital regulation (regulation), which imposes responsibility on companies throughout the EU on their platforms. It is entirely in force in the member countries from February 17, 2024 (PAP)
