The Ministry of Finance has prepared a draft amendments to the provisions on mandatory civil liability. Insurers will be able to check whether the PESEL car owner is reserved and refuse to conclude an insurance contract, all to limit fraud related to identity theft.

The draft amendments to the Act on compulsory insurance, the Insurance Guarantee Fund and the Polish Motor Insurers' Office and the Act on population records appeared yesterday in the list of works of the Council of Ministers. The amendment to the provisions is to enable insurance companies to verify the PESEL number of persons who conclude compulsory civil liability agreements of motor vehicles.

Communication civil liability insurance only with an important PESEL number

The Ministry of Finance, which is the author of the project, as a goal indicates limiting situations in which the conclusion of a communication agreement occurs using stolen personal data. Currently, insurers are not able to check whether the vehicle owner has a reserved PESEL, while there are often situations when scammers buy cars for stolen personal data, and then conclude a civil liability contract for random people. According to the law, they cannot refuse this here, and as a result, the Insurance Guarantee Fund later appears with a claim for payment of a contribution to a person who, although listed as a car buyer, has never been.

After the amendment, insurers will be able to check whether the vehicle owner has a reserved PESEL number and refuse to conclude a communication civil liability contract. This is to protect random persons whose data was used when buying cars, against liability for the lack of liability.

The cheater can buy a car for everyone

As noted by TZYZNIEK.PL, theft of identity applies not only to loans, but also to buy and sale of motor vehicles. In the case of Mr. Mariusz, who sold the old car, the data was used to buy a dozen or so vehicles, then scrapped by fraudsters. Criminals avoided the payment of civil liability from their own pocket, but as the owner of the vehicle there was an injured man to whom UFG turned to claims. Another story concerned a 45-year-old woman who never had a car or a driving license, and unexpectedly became the owner of 19 cars. In both cases, the police proceedings did not bring results, but it was people who were stolen had to prove that they had never bought vehicles and were exposed to legal problems.

Severe penalties for the lack of liability insurance

UFG in 2023 identified nearly 350,000 people who did not have mandatory civil liability of motor vehicles. The gaps in the regulations that allow you to report online car sales not only to the communication department, but also to the insurer, make everyone unknowingly become the owner of the vehicle obliged to continue and pay the policy. In the mobile, you can check whether and what cars we have, while on the UFG portal we will verify the communication civil liability contracts in force for us. In the case of irregularities, let's report the suspicion of a crime as a police and contact UFG, otherwise the office will charge us really high penalties for the lack of a valid liability. In 2025 they amount to

  • • PLN 1870 for lack of insurance from 1 to 3 days,
  • • PLN 4,670 in the absence of civil liability from 4 days from 14 days,
  • • PLN 9330 for no liability insurance over 14 days.

As we mentioned, insurers are not able to verify the reservation of the PESEL number of the vehicle owner and refusal to conclude an civil liability contract. The designed changes should limit the scale of the theft of identity in the sale of cars using random data.
