Russian banks were banned from introducing new credit card commissions

The Supreme Court of the Russian Federation forbade banks unilaterally introduce new commissions on credit cards, the decision of the Judicial Collegium for Civil Cases, which RIA Novosti got acquainted.
The court examined the complaint of a resident of St. Petersburg. In 2022, he issued a credit card at Alfa-Bank, under the terms of the contract, he could take up to 50 thousand rubles per month in cash per month. However, a month later the bank introduced the commission – 5.9% of the amount plus 900 rubles. He replied to the claim of the borrower that the contract stipulated the right of the bank to amend the terms of the contract and unilaterally to tariffs.
The courts of the three instances sided with the bank. Only the Supreme Court of the Russian Federation did not agree with this.
“Neither the law on banks and banking activities, nor the law on consumer loan provides for the bank’s right to unilaterally change the terms of the contract and establish other amounts of commissions or new commissions, since such changes entail an increase in the amount of the borrower’s monetary obligation under the consumer loan agreement (loan),” it was determined.
The court called the “insignificant” decision on the commissioning of the commission for lifting cash and sent the case for a review, indicating the courts to take into account the comments set forth in the ruling.
