“He couldn't confuse him with a wild boar.” Former village administrator, convicted of shot bison Pyrka

B. Sołtys Warcina 25-year-old Remigiusz C. was legally sentenced to a year and 5 months in prison in the appeal process about, among others Shooting Żubr Pyrka. The District Court in Słupsk thus upheld the judgment of the Court of first instance on Thursday.

Only the main accused Remigiusz C. appealed against the judgment of the District Court in Lębork, which was made against five accused on January 23, 2023. A final judgment was passed on Thursday.

The three -member judge, chaired by judge Jacek Żółt, upheld the judgment of the Court of first instance against Remigiusz C.

For killing the bison “Pyrka”, poaching, trade in hunting weapons, its illegal possession and driving without permissions, the village administrator of Wartcin was sentenced to a total penalty of 1 year and 5 months in prison.

Remigiusz C. is to pay a number in the amount of 15,000 PLN to the West Pomeranian Nature Society in Szczecin for the intended protection of the bison. For 2 years he is banned from driving. It is to pay 6.9 thousand PLN and jointly and severally with Przemysław P. 28.9 thousand PLN for the victim of the Pomeranian Voivode representing the State Treasury as repairing the damage caused.

Remigiusz C. is also to pay 6,000 PLN as part of the court costs of the trial that took place before the District Court. The District Court also charged him with costs in the amount of over PLN 300.

“The judgment of the District Court in Lębork is correct. The total penalty is within the lower limits of the statutory threat. Penal measures and unit penalties have been established correctly” – the judge bile judged the judgment orally.

In the Court's opinion, there was no absolute reasons for the appeal, i.e. the improper cast of the court, because the judgment was to issue the so -called Neosędzi, as the defender of the accused pointed out in the appeal.

Judge bile said that the court shares the position of the Courts of Appeal and the Supreme Court, indicating a faulty procedure for filling judges. “At the same time, it is necessary to differentiate those situations where the judge obtained nominations in the only way possible for him. In this case, by taking a judicial application, by passing the judicial exam, by taking assessment (…) and then by obtaining the nomination of the National Court Register and the President's signature. That it is an independent, independent court and thus there was no violation and this absolute reasons for the appeal, “said the chairman of the adjudicating panel.

The court decided that there was no premise for the use of extraordinary alleviating the punishment, because the crime was not of an organized crime. The accused did not commit them in cooperation with several other people, or possibly one.

In addition, the accused confessed to some acts, poaching, two arms sales and to two illegal possession of weapons, and here his fault does not raise doubts of the Court.

However, in terms of killing a bison “it is difficult to find any soothing circumstances”. “The accused was never a hunter, he was a beaten, he was passionate about his weapon, he was passionate about hunting. He was not punished, he had good opinions, acted socially, he acted in the Great Orchestra of Christmas Charity. I think that there would be no obstacles to legally become a hunter. But he went another way” – said the judge bile.

In the Court's opinion, the accused did not confuse the bison with a wild boar, he knew what he was shooting. Judge bile emphasized that the witness, a bison expert, testified in the trial that such a mistake was impossible. The evidence showed that the bison stood, both shots were not fired from the same position, one of the close range.

The accused Remigiusz C. appealed to the announcement of the sentence. After leaving the courtroom, he told reporters that he regrets what had happened. He will talk to the defender about the possible bringing of cassation to the Supreme Court.

Substantive penalty sentences of suspended and fine, which was issued by the District Court in Lębork towards other accused in this case, became final in 2023.

Żubr came in Pomerania in spring 2019. He was an attraction of Lębork forests. He wasn't afraid of people. He was trusting, he approached nearby houses. The inhabitants of local villages even gave him a name, they called him Pyrek, because the male liked potatoes.

In the late afternoon, Remigiusz C. and Przemysław P., who were detained on February 1, 2020, and on February 3 they heard allegations of killing an animal remaining under species protection.

Men knew each other from earlier hunting in which they participated as beaters. Remigiusz C. bought a doublet on OLX, and then a friend of the hunter supplied him with ammunition. During the investigation, he claimed that he did not see that he had killed the bison Pyrk, he confused him with a boar. With Przemysław P. he cut off the bison head and cut off his tail himself.
