The Trump administration has deported a 2 -year -old girl, an American citizen, “without a fair trial,” a federal judge said on Friday, while the child's father is trying to bring her back to the United States, Reuters reported.

Federal judge Terry A. Doughty said that the little girl, known in the court documents as “VML”, was deported with her mother.

“It is illegal and unconstitutional to deport, to remember for deportation or to recommend deporting a US citizen,” said Doughty.

He scheduled a hearing for May 19 “in the interest of wasting our strong suspicions that the government simply deported an American citizen without a fair trial.”

VML was arrested by the US Immigration and Customs Control Service on Tuesday, along with his mother, Jenny Carolina Lopez Villela, and her older sister, when Villela participated in a routine programming at the New Orleans office, according to a statement signed by Trish Mack, who said that the girl's father asked her.

According to Mack's statements, when the girl's father spoke briefly with Villela, she could hear her and the children crying. At that time, according to a court of the court, he reminded them that their daughter is an American citizen “and cannot be deported.”

Prosecutors say the little girl can enter the US

However, prosecutors said that Villela told the Immigration Bureau (ICE) that she wants to keep the girl's legal custody and take her in Honduras. They said that the man who presented himself as VML's father did not show up at ICE, despite the requests to do so.

“Therefore, it is in VML's interest to remain under the tutelage of her mother,” Trump administration officials said in a Friday deposition. “Moreover, VML is not exposed to the risk of irreparable damages, because it has American citizenship.”

Prosecutors added that the 2 -year -old girl is not forbidden to enter the US.

The Department for Internal Security and the Department of Justice did not respond immediately to Reuters comment requests.

The American Union for Civil Rights described the case of VML – and the similar one – as a “shocking abuse of power”.

“These actions are a direct violation of their own written and informal directives of ICE, which require the coordination of the care of minor children with carers to take care – regardless of their status of immigrants – when deportations are made,” the statement said.

Hundreds of people deported to El Salvador

US President Donald Trump, whose election campaign has largely focused on immigration, said earlier this month that he wants to deport to El Salvador some violent criminals who are American citizens.

The comments have aroused concern about a proposal that alarmed the defenders of civil rights and is considered by many lawyers to be unconstitutional.

The Supreme Court ordered the Trump administration, which has already deported hundreds of people to El Salvador, to “facilitate and carry out” the return of Kilmar Abrego Garcia, a resident to Maryland, who was sent to this country on March 15, despite an order that protects him from deportation.
